Let all of them secede – The Rest of Us Need the Money!

“We the People” is a website created by the White House where U.S. Citizens can create petitions on any subject of interest to them. 25,000 signatures are necessary for the petition to receive further attention from the White House.

Since President Obama’s re-election this website has been bombarded with petitions from various states wanting to secede from the Union and I say “Good Riddance”.

To date, there has only been one state that has reached the 25,000 threshold and that is the State of Texas with 93,972 votes as of November 14, 2012. According to the Census Bureau the estimated population for 2011 for the State of Texas is 26.7 million, so although 94,000 is a pretty fair number, its minute when it comes to total population. 267,000 signatures would only amount to 1% of the population.

The petition reads as follows:

Seems the folks in Texas can’t make up their minds because while the State of Texas is requesting to secede, citizens in the City of Austin have a separate online petition to remain part of the United States.

So what happens now? Probably nothing. In 1869 the Supreme Court ruled in Texas v. White that it was illegal for Texas to secede from the Union which is probably good for the people in the State of Texas. No matter how much they dislike the fact that President Obama was re-elected to a second term, the fact remains that Texans do not do a very good job of supporting themselves.

$163 billion dollars was the amount paid to the IRS from Texans in fiscal year 2009, while the State received $224 billion in federal funds, or to put it bluntly U.S. taxpayers from other states paid $61 billion dollars to residents of the State of Texas.

Is it any wonder Governor Perry’s office made the following statement on Tuesday, November 13, 2012:

"Gov. [Rick] Perry believes in the greatness of our Union and nothing should be done to change it," his press secretary Catherine Frazier wrote in a statement. "But he also shares the frustrations many Americans have with our federal government."

Texas may be the largest state in the Union, but it’s also the state that has the highest number of natural disasters requiring FEMA assistance as follows:

The Republican Wall of Ignorance

Speaker John A. Boehner (R-OH) made the following statement on November 9, 2012, which is the same position the Republican Party has taken for years on the subject of taxes.

“Raising tax rates will slow down our ability to create the jobs that everyone says they want,” said Mr. Boehner

The Congressional Research Service (CRS) prepared a report comparing job growth under President Clinton and higher tax rates, to job growth under President Bush and lower tax rates.

As usual, the numbers speak for themselves (see graphic above).

The annual average on Private employment growth doubled under higher taxes, while business investment growth nearly doubled increasing from 5.6% to 10.3%. In addition, seven of the nine major economic indicators increased under higher tax rates. One remained the same, and one decreased .2 percentage points.

Data from 2001 and 2002 was not included in the calculations due to the fact the tax increases were not fully impletemented until 2003. Data from 2008 was not included due to the Great Recession which began that year.

GDP growth was also higher at an annual average of 3.9% under higher taxes, compared to 2.7% under lowered tax rates.

Two of the major tax cuts passed during the last decade were the Economic Growth and Tax Relief Reconcillation Act of 2001 – P.L. 107-6 and the Jobs and Growth Tax Relief Reconciliation Act of 2003 – P.L. 108-27. Please note the word “growth”. The tax cuts were intended to spur job growth in this country. That was the entire purpose of providing the cuts, but they were a gross failure and the country ended up losing more than 8 million jobs due to the tax cuts and subsequent recession.

Many times I have commented in my articles on how the public is being brainwashed by hearing things over and over again. If you hear something 10 or 12 times, most of us start believing it’s fact.

Is it possible the Republican Party has been so busy trying to brainwash the American public on how tax increases prohibit business growth that they have brainwashed themselves into believing it’s an actual fact? If not, how does one explain their ignorance on the subject of job growth, taxes and our runaway deficit?

The April 2011 CRS report on the budget deficit makes a crystal clear statement that the tax cuts were the major factor in our deficit as follows:

‘For the decade as a whole, it can be estimated that legislative changes have increased deficits, relative to the 2001 baseline projections, by $6.9 trillion. Laws enacted in 2001 and 2003, notably the “Bush tax cuts,” generated the largest 10-year increases in budget deficits.’ Source: Reducing the Budget Deficit – Policy Issues – CRS 41778

The Congressional Research Service is the policy research arm of the United States Congress. These are the experts assigned the task of researching the pros and cons of the various policies put forth by Congress. Speaker of the House Boehner would do well to start reading facts rather than relying on fiction.

Defining Democracy for the Majority [of special interest to women]

Looking up the word democracy in a lot of different sources will provide you with several similar meanings; but the two words that generally prevail in all definitions are ‘free’ and ‘equal’.

Are we free and equal?

We’re neither, we’re ‘controlled’. We’re controlled by a small group of white elites who believe freedom applies only to those that are equal to them. In other words if you’re not Caucasian and you’re not wealthy you’re not free and if you’re not a white male, you’re not equal.

A primary example of non-democracy at work is the early closing of the Winter Park Florida library, located in Orange County Florida. The library was evacuated with an estimated 300 people still standing in line that had waited for hours to vote, due to a suspicious package being found outside. The article goes on to say the package was a cooler that was later detonated by the bomb squad.

The two major political parties went to court, one to request an extension of voting hours to accommodate the folks that weren’t able to participate in our ‘free and equal’ election system and the other political party to appeal the court’s decision to provide four hours of extended voting.

According to the U.S. Census Bureau the State of Florida has an average white (non-Hispanic) population for 2011 of 57.5 percent; while Orange County figures come in at 45.8 percent. In other words Orange County has a population that is 11.7 percent higher in blacks, Hispanics, Asians, etc.

Is it any wonder the Party of “NO” would want to put the kibosh on this group of voters? If you’re wondering what a difference 300 votes can make, take a look at the results of the 2000 election results.

I had a personal experience involving ‘control’ in this election. Several weeks ago I received notification that my voting card had ‘expired’ and if I wanted to vote in the 2012 election I would have to mail in an application. I mailed the application, only to be sent another form to fill out, which I did; all the time seething that my predominately Republican county was putting voters through this nonsense.

I eventually got all my ducks in a row and voted by mail, but whether or not my vote will be counted is yet to be determined. As a former election judge I am fully aware of the large number of votes that aren’t counted in each election due to the voter failing to dot the “I’s, cross the “t’s”, not fill in the ovals completely or not sign the outside of the envelope on mail ballots.

We know by media reports that Republicans have done everything humanly possible in this election to limit the number of votes that President Obama will get from various sections of the country. Add to that the number of outright lies and innuendo that has been dumped on the average voter from the candidates, the Republican Party, and especially the Super Pac’s, and it’s totally amazing that any of us bother voting. I mean can you imagine waiting in line for six or seven hours to vote?

We do it because we, as Americans, believe in the way it should be. We believe that all the citizens in this country are equal and every one of us should have the right to the American Dream. The problem is we aren’t all equal. The Equal Rights Amendment written in 1923 by Alice Paul consists of three sentences as follows:

Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.

Section 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.

Section 3. This amendment shall take effect two years after the date of ratification.

In 1971 the ERA bill was approved by the U.S. House by a vote of 354-24 and on March 22, 1972 the U.S. Senate passed the bill by a vote of 84-8.

There are two separate ways a proposed amendment to the U.S. Constitution may be made; one has never been used so the most common is for the bill to be sent to the individual state legislatures for ratification, or approval. Generally there is a time limit placed on the bill and the time limit was originally set at 7 years. Since the ERA amendment was not ratified within the original 7 year period, a bill has been reintroduced into Congress on a regular basis. The latest bill for the ERA was introduced on 10/2/2012.

The ERA bill already has approval of 35 of the 38 states necessary for ratification and once three more states ratify it will become an amendment to the U.S. Constitution.

We only need three approvals out of a possible 15 states, but the majority of these states are what are considered “red/ or Republican’ states and the possibility of a female getting ‘equal rights’ in a red state are between zip, zero and nada.

Please do not confuse equal rights for women, with equal pay for women. The Lilly Ledbetter Fair Pay Act of 2009 was the very first bill signed into law by President Obama when he took office in 2009. This bill provides equal pay for women for equal work.

Equal rights for women require a constitutional amendment. Women will never have equal rights under a Republican president because in simple English, Republicans do not feel women are their equals, as can be determined by bill after bill they have introduced taking away women’s right.

Your vote on November 6, 2012 (assuming you have not already voted) will not only affect your future, but the future of all the women in this country.

Yeah Right!

Just finished reading a New York Daily News article stating the latest Gallup Poll shows Governor Romney is now ahead of President Obama by a whopping seven points based on Gallup’s poll of ‘likely’ voters.

When I quit laughing at the absurdity, I decided to take a look at how Gallup came up with their spiffy nifty poll numbers.

My idea of a poll is as follows: You call up xxx number of registered voters, representing Republicans, Democrats and Independents and you ask the following question.

If the Presidential election were to be held today would you vote for President Barack Obama, the Democrat or would you vote for Governor Mitt Romney, the Republican candidate?

When you’re all done you add up the number of registered voters that would vote for Romney and the number of registered voters that would vote for Obama and you have a winner! Voila’

The problem with my poll is it doesn’t provide the means for playing games with the numbers so it would never work in our real world of deceptive politics.

For some reason Gallup does not think asking a registered voter who they’re going to vote for is the way to go so instead of asking potential voters one question; they ask seven more and then they weigh the questions and answers. Their method of polling is so complex they have a full page of explanations called “Understanding Gallup’s Likely Voter Procedures for Presidential Elections“.

If you read the fine print you’ll see that Gallup may or may not use all answers to all questions, so why bother asking?

My first problem with their polling is they do not start with registered voters. I mean really and truly who cares how someone may vote if they are not even registered to vote? Do you care who Charlie Chimp down the street might vote for if Charlie isn’t registered to vote? I don’t.

If you have some time take a look at their polling procedures and then ask yourself how much credence anyone in this country can give a Gallup poll?

1.7% COLA Increase for Social Security Beneficiaries for 2013

Social Security benefits are being paid to roughly 62 million Americans. The largest portion, 56 million will see the 1.7 percent increase on their January 2013 checks, while the remaining SSI beneficiaries will receive the increase on their December 31, 2012 check.

P.L. 92-336, established automatic increases to Social Security and SSI benefits each year based on the percentage CPI-W [Consumer Price Index for Urban Wage Earners and Clerical Workers] increased from the third quarter of the last year a COLA was determined to the third quarter of the current year. The actual CPI-W percentage is calculated by the Bureau of Labor Statistics. Prior to the signing of P.L. 92-336 Cost of Living Adjustment Allowances were only made when Congress approved an increase.

Good thing we have P.L. 92-336 because the chances of the 112th Congress approving a COLA increase for anyone other than the very wealthy is probably between slim and none. On the other hand, perhaps the vision of 62 million old folks beating on the walls of Congress with their umbrellas, canes and walkers is incentive enough.

It is estimated 163 million workers pay into Social Security. Out of that 163 million, approximately 10 million will pay higher taxes in 2013 as the maximum amount of earnings subject to the Social Security tax will increase from $110,100.00 to $113,700.00.

Social Security and Medicare tax rates are scheduled to stay the same for 2013 as they are for 2012. As indicated on the following Social Security chart, we are operating under a 2% reduction which is scheduled to expire at the end of December 2012.

It is highly unlikely this rate will increase by the 2% for calendar year 2013 due to the extraordinary burden it will place on the middle-class.

As of June 30, 2012 approximately 89 percent of American individuals age 65 and over were receiving Social Security benefits.

At least 40 percent of those receiving Social Security benefits in 2012 rely entirely on their Social Security benefits for survival as they have no other income. Please take that fact into consideration when you vote on November 6.

15 States, 19 Deaths, 247 Reported Cases*

The Tennessee Department of Health was first notified on September 18, 2012 of culture-confirmed, Aspergillums fumigatus meningitis. This diagnosis was made 46 days after the patient had received an epidural steroid injection at a Tennessee surgery center.

Within nine days an additional eight patients were clinically diagnosed through collaboration with the CDC, Tennessee Department of Health and the North Carolina Department of Health and Human services. Seven of these patients were in Tennessee and one was in North Carolina.

All nine infected patients had received one or more epidural steroid injections with preservative-free methylprednisolone acetate solution (MPA), compounded at NECC (New England Compounding Center) located in Framington Massachusetts.

It was determined the injections had come from one of three lots of MPA (lot numbers 05212012@68; 06292012@26; and 08102012@51).

During the subsequent investigation, NECC provided the CDC with invoice information indicating approximately 17,500 vials of MPA (80 mg/ml) from these lots had been packaged in 1ml, 2ml, and 5ml vials and subsequently distributed to 75 different facilities in 23 states for treatment of both peripheral joint and back pain.

NECC voluntarily recalled these three lots on September 26, expanded the voluntary to all lots of MPA and all lots of sterile products used for intrathecal injection by October 3 and followed up with a voluntary recall of all remaining products on October 6, 2012.

Follow-up investigations by CDC as well as state and local health departments indicated there were almost 14,000 patients potentially exposed to medications from at least one of the lot numbers and by October 10, 2012 the various departments advised CDC that approximately 90% of all patients had been contacted at least once, by telephone, voicemail, home visit or registered mail.

Four separate categories of cases have been identified as follows:

  1. Fungal meningitis or nonbacterial and nonviral meningitis of subacute onset following epidural injection on or after May 21.
  2. Basilar stroke following epidural injection on or after May 21.
  3. Spinal osteomyelitis or epidural abscess at the site of injections following epidural or sacroiliac injection on or after May 21.
  4. Septic arthritis or osteomyelitis of a peripheral joint (e.g., knee) diagnosed following injection of that joint on or after May 21

Clinical meningitis was defined as having one or more symptoms (e.g., headache, fever, stiff neck, or photophobia) and CSF pleocytosis.

Clinically diagnosed septic arthritis was defined as new or worsening pain with presence of effusion or new or worsening effusion.

Many times during this election cycle we have been subjected to the Republican term “Job-Killing Regulations“.

I don’t know about the rest of you, but I’d rather have a few jobs “killed” over government regulations than thousands of Americans dead because the regulations weren’t there to protect the public.

It will be months and perhaps years before we know all the answers to why these particular batches of MPA caused so many deaths and illnesses. In the meanwhile we can be extremely grateful to the CDC, other government agencies as well as Epi-X (the CDC electronic health notification system) for working so quickly to obtain the necessary information on the 14,000 potential cases and notify those patients of the possibility of exposure.

This particular story hits close to home as I’ve had numerous epidural injections over the past several years without side effects. The reason a person has a sacroiliac or epidural steroid injection is because they are in considerable pain and the injection generally takes away a certain amount of pain for a specific period of time, but they don’t always work. I can’t imagine what it would be like to have the injection and then get notified that due to the injection you may be subjected to a life-threatening illness.

So Who Pays the Capital Gain Tax?

Did you ever read something and a certain portion of it caught your eye because it just didn’t look right, yet you just couldn’t put your finger on what was wrong with it?

The day Governor Mitt Romney released his tax returns for 2010 and 2011 I spent some time reviewing the numbers. One of the many hats I wore during my career was that of corporate accountant so I probably spent a little more time reviewing the returns than the average voter and the more pages I read, the more questions were raised. I thought sooner or later I’d go back and spend a little time digging into the numbers. Unfortunately, time isn’t something that I have an abundance of lately so the tax returns went to the bottom of the pile, but one question just kept popping into my head.

Who pays the capital gain tax on the $920,573.00 indicated as a non-cash donation to charity on the Romney’s 2011 Federal Tax Return?

If you go to STMT 5, you’ll see that the non-cash donations totaling $920,573.00 originated on Form 8283.

Form 8283 indicates three separate donations to the Tyler Foundation in Boston Massachusetts in the form of shares of stock as follows:

Sensata – 7,243 shares with a market value of $232,863.00

Warner Chilcott – 19,799 shares with a market value of $468,840.00

Dunkin Brands – 8,600 shares with a market value of $218,870.00

There is a Tyler Foundation in Boston that makes donations to parents whose children are undergoing epilepsy treatment at Children’s Hospital Boston, or UMass Memorial Children’s Medical Center.

Unfortunately that Tyler Foundation is not the recipient of the $921 thousand dollars in stock; instead it was Governor Mitt Romney’s personal foundation, the Tyler Charitable Foundation. Past donations from this foundation have been to GOP causes [$260,000] and the George W. Bush Presidential Library [$100,000].

The most recent tax return for the foundation, calendar year 2009, does list some actual donations to organizations that will probably do some good with the money as follows: My Sister’s Keeper received $5,000., and the Cancer Center at Massachusetts General Hospital received $1,000.

Out of the $631,000., the two large contributions went to Church of Jesus Christ of the Latter-Day Saints, $600,000. and The Beckett Fund, a Boston law firm, received $25,000. This particular law firm litigates on behalf of different religious groups and one of its most recent cases was representing the Muslims in Tennessee who had been trying to get a permit to use their new mosque, The Islamic Center in Murfreesboro, in time for Ramadan.

Our tax system is such that Mitt Romney can donate almost a million dollars in stock to his own personal foundation, use the money for whatever purpose he chooses and it’s all quite ‘legal’.

I think it’s totally unethical, but that’s simply a personal opinion. My real concern is not what is done, but what isn’t done. It’s unlikely the Romney’s purchased the above listed stock for $921,000 so what happens to the capital gains on this stock?

Who pays it and when, or does it also just disappear into the woodwork along with all the other taxes that fall through the cracks due to loopholes?

The Unbelievably Flawed Thinking of Presidential Candidate Mitt Romney on Taxes

It’s true – the March 20, 2010 decision on SpeechNow v. FEC and the January 2010 decision on Citizens United v. Federal Election Commission had me wondering whether or not the little people would be able to compete with the big boys. Would the airways, TV stations, newspapers, internet, etc. be so completely bought out by big money that voters would be forever brainwashed and back the GOP candidate?

We probably won’t know the answer to that question until after the election, but in the meanwhile President Obama is getting more help than he needs, from none other than the opposition. Following is a link to the You Tube video where Presidential Candidate Mitt Romney made the statement 47% of Americans pay no income taxes.

There’s only one thing that needs to be said about the video, the statement and Governor Romney as a presidential candidate. He doesn’t appear to have the facts correct about U.S. taxpayers and how taxes are calculated, so how can he possibly run on a platform to cut taxes?

Taking a legal deduction on your tax return does not make you a victim or dependent upon the government for your keep as Romney suggests in the video.

Following is a listing [1] indicating more than 100,000 tax payers paid .00 taxes for 2011 with incomes starting at $211,000 through $2.2 million. No matter how you stack ’em these people cannot be considered ‘victims’ or ‘dependent upon the government’ for food, housing, etc.

 

The reduction in capital gains tax and the Capital Loss Carryover made it possible for investors to have a big loss in 2010 and carry it forward to offset 2011 capital gains tax liability.

Romney claimed 47% of taxpayers paid no taxes for 2011 which isn’t an accurate statement [2], but ignoring the actual percentage, the majority of the taxpayers that paid no taxes were the very poor and the elderly, blind and disabled. Is Governor Romney actually suggesting that these people have their taxes increased so the rich can receive more tax cuts?

The rich received one tax cut after another during the Bush Administration and these cuts have been extended year after year by our Republican controlled Congress. If there’s any question in anyone’s mind about how well the rich have been doing all you have to do is a take a look at the latest Forbes 400 listing which indicates the net worth of the super-rich has jumped 13.0 percent in the past year, with an average net worth of $4.2 billion per person. Did your net worth jump 13 percent in 2011?

The only people that aren’t paying their fair share of the taxes in this country are the very rich. Historically taxes on the rich have been at 70% during periods of war. We are, and have been in two wars for the past 10 plus years and taxes on the rich during that same period of time have been cut by 50 percent.

It doesn’t take a financial wizard to figure out whose taxes should be cut and whose taxes should be increased.

THAT GREEN THING

Checking out at the store, the young cashier suggested to the older woman, that she should bring her own grocery bags because plastic bags weren’t good for the environment.

The woman apologized and explained, "We didn’t have this green thing back in my earlier days."

The young clerk responded, "That’s our problem today. Your generation did not care enough to save our environment for future generations."

She was right — our generation didn’t have the green thing in its day.

Back then, we returned milk bottles, soda bottles and beer bottles to the store. The store sent them back to the plant to be washed and sterilized and refilled, so it could use the same bottles over and over. So they really were recycled.

But we didn’t have the green thing back in our day.

Grocery stores bagged our groceries in brown paper bags, that we reused for numerous things, most memorable besides household garbage bags, was the use of brown paper bags as book covers for our schoolbooks. This was to ensure that public property, (the books provided for our use by the school) was not defaced by our scribbling. Then we were able to personalize our books on the brown paper bags.

But too bad we didn’t do the green thing back then.

We walked up stairs, because we didn’t have an escalator in every store and office building. We walked to the grocery store and didn’t climb into a 300-horsepower machine every time we had to go two blocks.

But she was right. We didn’t have the green thing in our day.

Back then, we washed the baby’s diapers because we didn’t have the throwaway kind. We dried clothes on a line, not in an energy-gobbling machine burning up 220 volts — wind and solar power really did dry our clothes back in our early days.

Kids got hand-me-down clothes from their brothers or sisters, not always brand-new clothing.

But that young lady is right; we didn’t have the green thing back in our day.

Back then, we had one TV, or radio, in the house — not a TV in every room. And the TV had a small screen the size of a handkerchief (remember them?), not a screen the size of the state of Montana. In the kitchen, we blended and stirred by hand because we didn’t have electric machines to do everything for us.

When we packaged a fragile item to send in the mail, we used wadded up old newspapers to cushion it, not Styrofoam or plastic bubble wrap. Back then, we didn’t fire up an engine and burn gasoline just to cut the lawn. We used a push mower that ran on human power. We exercised by working so we didn’t need to go to a health club to run on treadmills that operate on electricity.

But she’s right; we didn’t have the green thing back then.

We drank from a fountain when we were thirsty instead of using a cup or a plastic bottle every time we had a drink of water. We refilled writing pens with ink instead of buying a new pen, and we replaced the razor blades in a razor instead of throwing away the whole razor just because the blade got dull.

But we didn’t have the green thing back then.

Back then, people took the streetcar or a bus and kids rode their bikes to school or walked instead of turning their moms into a 24-hour taxi service. We had one electrical outlet in a room, not an entire bank of sockets to power a dozen appliances. And we didn’t need a computerized gadget to receive a signal beamed from satellites 23,000 miles out in space in order to find the nearest burger joint.

But isn’t it sad that the current generation laments how wasteful we old folks were just because we didn’t have the green thing back then?

Please forward this on to another selfish old person who needs a lesson in conservation from a smartass young person…

We don’t like being old in the first place, so it doesn’t take much to tick us off.

The Trends on Job Creation

The job losses in this country began in February 2008 with a loss of 84,000 jobs and we continued losing jobs each month for the next 24 months, with February 2010 jobs losses at 35,000.  During that 24 month period of time there was not one single month where any jobs were created due to the Great Recession which began in December of 2007. 

The United States lost a total of 8.8 million jobs in that 24-month period.  The following chart indicates job gains/losses, by month, for the four-year period beginning January 2008 and ending December 2011.

In the 22-month period between February of 2010 and December of 2011, the U.S. added 2.9 million jobs.  Obviously, that’s a far cry from the 8.8 million lost, but we’re headed in the right direction, adding jobs instead of losing them on a daily basis.

The 115,000 jobs created in April of 2012 may seem shabby to some, but the fact is, that was the 19th straight month of job creation in this country and brought the total for 2012 to 534,000 jobs added.

How Far does it have to Fall before it’s considered a Failure?

The big news today is the $2 billion loss JPMorgan Chase & Co. racked up in the past six week period of time on credit derivatives. CEO Jamie Dimon stated the derivative bet was “flawed, complex, poorly reviewed, poorly executed and poorly monitored”. That little tidbit was announced last night and by the time the market opened this morning the DJIA was already on its way down, down, down.

$2 billion dollars is a lot of money, but it’s not the entire problem with JPMorgan Chase. In addition to the $2 billion dollar loss, they are also looking at $4.2 billion in excess of reserves for legal proceedings.

Most corporations operate under an accrual accounting system rather than a cash basis accounting system as the accrual method is considered to be more accurate. Example, under a cash system a company would indicate what was actually paid out in legal fees, while under an accrual system they would accrue for the various legal expenses they expect to incur during that period. We’ll use $500,000.00 as an example. Let’s assume JPMorgan Chase accrued $500 million a month for legal fees and at the end of the quarter their accrual was $1.5 billion, yet legal fees to date were $5.7 billion. The difference is the $4.2 billion ‘excess of reserves’.

$4.2 billion may be a drop in the bucket by the time the regulatory probe for alleged fraud is completed by the Office of Comptroller of the Currency. The allegations against Chase were made by former employees of the company. Chase was allegedly selling delinquent credit card accounts to collection agencies after they had already taken their customers to court and judgments were issued against the borrowers. We’re talking about tens of thousands of delinquent customers.

Companies that have outstanding past due receivables have a few choices, they can turn the account over to a collection agency for a set fee, the collection agency gets a percentage and the company gets a percentage, or they can sell the account to the collection agency for pennies on the dollar, in which case the collection agency keeps all monies collected, or they can take the customer to court and obtain a money judgment against the customer. What they cannot do is take the customer to court, obtain a judgment and then sell the account to a collection agency.

Whether or not Chase is guilty of fraud is yet to be determined, but one thing is for certain this is going to put another black mark against an industry that appears to put its bottom line ahead of anything and everything else.

JPMorgan Chase & Co. was ranked # 16 on the Fortune 500 listing for 2011 indicating the following numbers for revenues and profits (in millions of dollars).


Dimon’s comments on the financial condition of Chase follows: “I’ll be damned if we don’t have record profits at least for a while now.”

It will be interesting to find out how much of Chase’s profits are based on legitimate earnings v. fraudulent creative accounting practices.

The Sky is Not Falling on Social Security and Medicare

The Social Security Act requires an annual report to Congress on the actuarial status and financial operations of OASI and DI Trust Funds, as well as Medicare Trust Funds. The 2012 report is the 72nd report issued by the Board of Trustees and indicates the following statistics for Old-Age and Survivors Insurance (OASI) and Disability Insurance (DI) Trusts.

A total of 55 million recipients were listed as receiving benefits at the end of 2011 accounting for $736 billion in expenditures:

38 million Retired Workers and Dependents of Retired Workers
6 million Survivors of Deceased Workers
11 million Disabled Workers and Dependents of Disabled Workers
55 million TOTAL

During the same period 158 million workers paid payroll taxes due to receiving earnings covered by Social Security taxes to the tune of $805 billion. Combined trust funds held in special U.S. Treasury Securities increased at the end of 2011 to a total of $2.7 trillion dollars.

The latest report indicates the Trust Fund for Social Security OASI reserve benefits will be exhausted by 2033 (three years earlier than the 2011 report) while the Trust Fund reserve for Disability benefits will be depleted by 2016 (two years earlier than the 2011 report). The word ‘exhausted’ simply means the trusts would not be able to pay 100 percent of benefits past 2033 for OASI and 100 percent of benefits past 2016 for DI. Beneficiaries would still be able to obtain reduced benefits. Where they would be scheduled to receive 100 percent prior to the two dates, they would only receive 75 percent in benefits for the remainder of the 75-year period in question. That would be under the assumption that nothing changed in future years.

The Medicare Hospital Trust will remain solvent through 2024 when 100 percent of benefits would be paid, (no change from the 2011 report), and past that date the percent of payments would drop to 87 percent for the remainder.

A key to understanding the trustee’s reports is to realize actuarial status and financial estimates are based on current statuses spread over a 75-year period of time and include a tremendous amount of data.

The information you would expect to be included in the calculations is as follows:

  • Covered Employment
  • Insured Population
  • Old-Age and Survivors Insurance Beneficiaries
  • Disability Insurance Beneficiaries
  • Covered and Taxable Earnings, Taxable Payroll and Payroll Tax Contributions
  • Income from Taxation of Benefits
  • Average Benefits
  • Benefit Payments
  • Scheduled Benefit Amount

But calculations also include:

  • Administrative Expenses
  • Railroad Retirement Financial Interchange
  • Military Service Transfers
  • Labor force and Unemployment Projections
  • Gross Domestic Product Projections
  • Interest Rates

Long-range analyses are also based on the following data:

  • Fertility Rates
  • Death Rates
  • Net Immigration
  • Real-Wage Differential
  • Consumer Price Index
  • Disability Incidence Rates
  • Disability Termination Rates

This is not an all-inclusive listing of all data included in the calculations. The fact the Trustees report itself is 252-pages long gives you an idea just how much data goes into the actuarial estimates.

A slight change in any of the various factors included in the report will significantly impact the outcome. Example – Public Law 111-312, Public Law 112-78, and Public Law 112-96 reduced the OASDI payroll tax rate for 2011 and 2012 by two percentage points for employees and for self-employed workers, which created trust deficits of $45 billion for 2011 and a proposed $53 billion for 2012.

For purposes of the trust reports, a program is solvent at any point in time when it is able to pay scheduled benefits, when due, with scheduled financing. The OASDI program would be considered solvent in any period when the trust funds maintain a positive level of assets.

So what would it take for the OASDI Trust Finds to remain solvent throughout the 75-year projection covered in the 2012? All it would take is a tax increase of 2.61 percentage points.

Think about it for a minute, for a little more than a 2 ½ percent increase in taxes, from the current level of 12.40 percent to 15.01 percent, both the OASI and DI Trusts would be solvent for the next 75 years.

The Two Sides of Truth a.k.a. Deficit 101

We can generally assume there are two sides to any statement, which has been made abundantly clear in the Treyvon Martin, George Zimmerman shooting. There is the George Zimmerman version that he shot the young man in self-defense, and the statement made by the girlfriend, that she was on the phone with Treyvon Martin when the shooting occurred and Treyvon was not the aggressor, quite the opposite, he was frightened because he was being followed by Mr. Zimmerman.

The Grand Jury is scheduled to hear this case on April 10, 2012 so eventually folks will be able to determine what really happened on the evening of February 26, 2012 when this youngster was shot to death. In the meanwhile all we can really do is speculate about the circumstances surrounding the shooting on that sad, rainy evening, three weeks ago.

The GOP unveiled Representative Paul Ryan’s 2013 Budget presentation “The Path to Prosperity – A Blueprint for American Renewal” on March 20, 2012 with considerable emphasis placed on the national debt. Their claim for the day is President Obama increased the national debt more in the past three years and two months, than the national debt was increased during the 8-years President Bush was in office.

There is no question the national debt has increased tremendously over the past three years based on the fact we have had incredible budget deficits during that same period of time.


The Republicans will have you believe the extraordinary deficits and subsequent additions to the national debt are ‘spending’ related and to a certain extent what they are saying is 100% true. We are spending considerably more than we are taking in each month, but where does the fault lie for the “out-of-control” spending?

President Bush came into office on January 20, 2001 and the budget for FY 2001 had already been put in place by his predecessor, President William J. Clinton. President Obama came into office on January 20, 2009 and the budget for FY 2009 had already been in place by his predecessor, President George W. Bush. It was known when the FY 2009 budget was submitted that it would incur a huge budget deficit that would carry over to the national debt. If you want to place blame on the 2009 budget it will have to go to President George W. Bush, not President Obama.

During the eight years President Bush was in office the U.S. Budget went from $1.86 trillion dollars in FY 2001 to $3.51 trillion dollars in FY 2009, or a budget increase of $1.65 trillion dollars for a fiscal year. If we were to extrapolate, just the budget increases President George W. Bush put in place for the three years President Barack H. Obama has been in office, $4.95 trillion dollars would have been added to the budget deficit, and subsequently the national debt during this three year period of time – without President Obama doing anything to increase the deficit.

On the other hand, you can see from the following table the budget increase under President Obama from 2009 through 2011 only totals $85.4 billion for a fiscal year. President Obama decreased the budget for FY 2010, and then increased it for FY 2011 to account for the 2% reduction in FICA taxes beginning January 1, 2011 and ending December 31, 2012.

Are the Republicans Really Going to Renege?

When it comes to politics, voters have many different levels of interest, so I’ll only list a few. We have voters that spend a considerable amount of time paying attention to what goes on in the political arena on an hourly/daily basis. There are those that read the news every once in a while and basically rely on someone else’s opinion when making decisions on how to vote. And finally you have those that live in a world totally devoid of politics. You almost have to envy the last group because in some ways you can live a more peaceful existence by not knowing what’s happening in this country.

Some political issues can’t be ignored and when August 2, 2011 rolled around I don’t think there was anyone in this country, or the world that wasn’t sitting on pins and needles wondering whether or not the Tea-Party Republicans were going to lead this country into default over the debt-ceiling crisis.

The crisis was finally resolved with the passage of The Budget Control Act of 2011, P.L. 112-25. This bill passed the Senate on February 17, 2011, but the U.S. House would not pass it until August 1, 2011, with an amendment which meant it had to go back to the Senate. The Senate concurred on the House amendment the same day and on August 2, 2011 the bill was signed into law by President Obama, exactly one day before the U.S. would default.

The antics of the Tea-Party Republicans created serious consequences for our country due to the fact Standard and Poor’s downgraded our AAA rating. There are 87 first-term Republicans in the 112th Congress, which equates to approximately 36% of U.S. House Republican members. They went into the House believing they could reduce spending yet appear to have tunnel vision. They are so hell bent on reducing spending they can’t seem to see the forest for the trees.

We started out in February of 2010 with the National Commission on Fiscal Responsibility and Reform [the Simpson-Bowles Commission]. That didn’t work so we went to the Joint Select Committee on Deficit Reduction [the 12-member Super Committee] which didn’t work either. No one could agree on anything when it came to spending cuts/tax increases.

In the interim, during the negotiations that actually began early in 2011, it was agreed, on August 2, 2011, by both the Republicans and the Democrats that for Fiscal Year 2013 [beginning October 1, 2012] discretionary spending would be $1.047 trillion dollars.

Actually, it’s not just an ‘agreement’, it’s the law. It’s very clear in The Budget Control Act of 2011 as follows:

$686,000,000,000 plus $361,000,000,000 is $1.047 trillion dollars, compared to $1,043 trillion dollars for FY 2012 and $1.066 trillion dollars for FY 2014.

Representative Paul Ryan submitted the Republican budget for 2013 this morning and it contains proposals for two tax rates, 10% and 25% [apparently without levels for each bracket]. It proposes eliminating the Alternative Minimum Tax; it proposes reducing the top corporate tax rate from 25% to 35% and it will have significant changes to Medicare.

According to the WSJ article GOP Budgets Taxes [written prior to the release of the budget] their new budget will also propose lower discretionary spending for FY 2013, from the previously agreed upon $1,047 trillion to a proposed $1.028 trillion or a reduction of $19 billion. However, Table S-4 of their plan indicates their plan is to actually reduce discretionary spending by $38 billion dollars.

Obviously the 10% and 25% tax rates are going to be appealing to some voters, but it will also reduce revenues by an estimated $4 trillion dollars over the next 10-years.

If you’ll recall correctly the primary reason why the very first tax cut was issued under President Bush was to return to the people the excess amount of money that had been accumulated under President Clinton. If you remember we had a large budget surplus when Clinton left office [$236 billion] the problem is that surplus was completely wiped out with the first year of Bush tax cuts. Additional tax cuts added to the deficit and subsequently added to the national debt year after year and continue to add to yearly deficits because the tax cuts are still in place, which is exactly why we’re in the financial mess we’re in now.

Seems the simple way to get the point across to the voters in this country is to ask one simple question. Are you better off now, still operating under the tax cuts and loopholes put in place by the Republicans under President George W. Bush that are still in place, or were you better off with the tax plan put in place during the Clinton years with a low tax rate of 15% and a high rate of 39.6% and reasonable rates for capital gains, inheritance taxes, etc.?

Apparently the Republicans have decided we no longer need the U.S. Supreme Court either as their new budget calls for -0- expenditures [Table S-5] for what they are calling “President’s Health Care Law”. They are probably referring to Patient Protection and Affordable Care Act, Public Law 111-148 [March 23, 2010] which is before the Supreme Court to determine the legality of mandatory premiums for beneficiaries and has not as yet been decided.

The Republican tactic for the 112th Congress has been to basically blackmail the Democrats into agreeing to this or that demand, in order to provide benefits to the people in this country that need the extra help to keep from going under. I’m referring to the millions that lost their jobs due to policies put in place by the prior administration. There are certain things these people need to survive and fortunately the Democrats [and some well-meaning Republicans] have been there for them – at a great cost to the country.

How many bills could have been processed creating jobs for the unemployed, while Republicans were wasting legislation time on things like extended unemployment benefits?

How many more days are going to be wasted by the Republicans pushing for reduced spending on a bill that was already agreed to and passed last year?

Delegate Counts That Don’t

Each and every day, and sometimes each and every hour, we are being updated on which candidate has the most delegates in the Republican campaign. Online news reports have now resorted to inserting a date and/or date and time next to the delegate counts because they are changing so rapidly.

The two counts that match, New York Times and Wall Street Journal, were both taken from the same source, the Associated Press.

The one thing everyone agrees is there are a total of 2,286 potential delegates and 1,144 delegates are needed to win the nomination.

The problem with any and all of these counts is they are just plain incorrect. Now I’m sure you’re going to wonder how anyone could possibly challenge counts indicated by major media and the answer is very simple. I no longer trust anything that anyone says when it comes to politics so I spend a lot of my time doing my own ‘fact’ checking.

Based on totals supplied to the Republican National Convention by the various states [IA, NH, SC, FL, NV, CO, MN, MO, ME, AZ, MI, WA, AK, GA, ID, MA, ND, OH, OK, TN, VT, VA, KS, Guam, No. Mariana Islands, U.S. Virgin Islands, WY, AL, America Samoa, Hawaii, and MS] as of March 16, 2012 the delegate count follows:

Please note: The numbers are subject to change after certification.

Obviously the difference between what the media is indicating and what the RNC is indicating is, in part due, to the 304 “unbound” delegates. Many of the races have unbound delegates and the media goes hog wild estimating who will eventually end up with these delegates based on their exit polls. The problem with exit polls is they’re not always correct.

Reading the small print in the online media numbers you will note there are certain statements made about what is, or isn’t, included in the delegate total. The problem is voters don’t read the small print; we barely have time to read the totals. When the winners are announced on TV, there are no disclaimers about what is or isn’t included in the delegate count.

Right off the bat we have already had seven caucus or primary races where the delegates don’t count because they’re ‘unbound’ until a later date. Those states are Iowa (28), Colorado (36), Minnesota (40), Missouri (52), Maine (24), North Dakota (28) and Washington State (43). The number of delegates is in parenthesis.

Let’s just look at the details from www.gop.gov on one state – Washington State with 43 delegates.

WASHINGTON:

Washington State is holding a non-binding caucus on March 3, in which no delegates will be bound by the result.

  • 10 At Large delegates will be bound at state convention 5/30-6/02/12
  • 30 Congressional District delegates will be bound at county caucuses 3/24-4/21/12
  • 3 RNC delegates will remain unbound.

Unfortunately, we are a society that wants to back a winner and if so and so is ahead in the polls, too many of us are incapable of thinking for ourselves and simply follow the crowd. Who would have been ahead in the most recent primaries if the actual delegate numbers were indicated by the media? Would Rick Santorum have received the number of delegates the media claims he has? Will he receive anything close to the number of delegates media has so graciously bestowed upon him? I believe the answer is a very definite ‘no’, due to the timing. There is enough time remaining for the delegates to actually look into the candidates and do their own ‘fact’ checking.

Voting in a primary or participating in a caucus is a good thing, if the final results actually mean something. The totals shouldn’t change with the direction of the wind, or the media preference and choosing the next President of the United States shouldn’t be a popularity contest.

Flynn staggered home very late after another evening with his drinking buddy, Paddy. He took off his shoes to avoid waking his wife, Mary.

He tiptoed as quietly as he could toward the stairs leading to their upstairs bedroom, but misjudged the bottom step. As he caught himself by grabbing the banister, his body swung around and he landed heavily on his rump. A whiskey bottle in each back pocket broke and made the landing especially painful.

Managing not to yell, Flynn sprung up, pulled down his pants, and looked in the hall mirror to see that his butt cheeks were cut and bleeding. He managed to quietly find a full box of Band-Aids and began putting a Band-Aid as best he could on each place he saw blood.

He then hid the now almost empty Band-Aid box and shuffled and stumbled his way to bed.

In the morning, Flynn woke up with searing pain in both his head and butt and Mary staring at him from across the room.

She said, “You were drunk again last night weren’t you?”

Flynn said, “Why you say such a mean thing?”

“Well,” Mary said, “it could be the open front door, it could be the broken glass at the bottom of the stairs, it could be the drops of blood trailing through the house, it could be your bloodshot eyes, but mostly…..it’s all those Band-Aids stuck on the hall mirror.

Rick Santorum’s Alabama Primary Win

Was it really a win?

On February 28, 2012, the U.S. District Court for the Middle District of Alabama issued an injunction extending the length of time allowed for receiving UOCAVA [Uniformed and Overseas Citizens Absentee Voting Act of 1986] ballots cast until March 31, 2012. That’s more than two weeks from now, so if these absentee ballots are not going to be counted until March 31, 2012 is it possible to call anyone a winner?

When I contacted the Alabama Secretary of State’s office the answer I was given when asked how the media could possibly call a winner, when their website doesn’t declare a winner, is the media sends reporters out to the precincts and they supposedly stay until the count is complete and phoned in. The Alabama election site is indicating 64.18 percent of the precincts reported (as of 12:54:31 PM CDT on March 14, 2012 – the day after the Alabama primary) so I’m wondering who it was that received the counts that were supposedly ‘called in’.

As a former election judge, normal operating procedure in my county is to provide the numbers immediately upon totaling the votes. Unfortunately, there are no statutes on the books in Alabama providing a timetable for Secretary of State notification before certification.

The vote has to be certified by the 23rd of March, but because of the injunction on Federal UOCAVA votes, the winner for the Federal office cannot be certified unless the winner is so far ahead in votes that the number of absentee ballots won’t impact the count.

Gerald A. Sandusky Trial

On March 13, 2012 a decision was made on the “Application for More Specific Bill of Particulars” stating the Commonwealth failed to provide specific details regarding the alleged crimes committed. The law in Pennsylvania states the Commonwealth must supply a date “fixed with reasonable certainty” when a defendant is accused of having sexually assaulted a child. It was determined the Commonwealth was unable to offer any details beyond what was already indicated in its “Bill of Particulars”; therefore the application was denied based on the fact it was a ‘moot’ point.

An attorney needs specifics, names, dates, times, and locations in order to prepare an adequate defense for any defendant; therefore the attorney for former Penn State Coach Gerald Sandusky, Joe Amendola, has stated he will be filing a motion to have charges dismissed and will submit to the court next week.

Sandusky is charged with 52 counts of child sexual abuse pertaining to the abuse of 10 children over a 10-year period of time.

Loopholes in our tax code has put us trillions of dollars in debt over the past three year period of time, let us hope and pray that loopholes in our legal system will not allow this man to walk away from these charges with no more than a slap on the wrist with a wet noodle.

Conservatism – What is it and What Does it Mean?

“Conservative” and Conservatism are words that have been used over and over again by most of the Republican presidential candidates.

The problem I have is I cannot seem to locate an in-depth definition for the word ‘conservative’. A definition that appears to have some consistency follows:

con·serv·a·tive/kənˈsərvətiv/

Adjective: Holding to traditional attitudes and values and cautious about change or innovation, typically in politics or religion.

Noun: A person who is averse to change and holds to traditional values and attitudes, typically in politics.

That definition may mean something to someone, but it doesn’t tell me what I want to know which is what exactly a ‘conservative’ is and how that label affects their political views?

I consider myself to be a person that is opposed to change and holds to traditional values and attitudes, but by no stretch of the imagination could I call myself a ‘conservative’ (based on the apparent lack of values and morals exhibited by those that claim to be conservatives).

Perhaps my confusion is hidden in the words “traditional values”. When I think about traditional values I think of some of the values I was taught as a child; don’t lie, steal, cheat; care for those that can’t take care of themselves; be kind, considerate and caring; respect authority, and take good care of your little brothers. If you knew how my little brothers behaved, you’d understand why the last one, without a doubt, is the most difficult to follow.

Above all else we were taught to love our neighbors. We grew up in the hustle, bustle of the city and maybe that’s why we never learned how easy it is to look down on something or someone else for no reason other than ‘it’s the thing to do’.

I attended church on a regular basis, when I was younger, and the one thing I learned over and over each week was my God loved everyone. It didn’t matter if they were black, white, Hispanic, Asian, European, Middle Eastern, Gay, on birth control, or on Viagra. We were all God’s children and he cared about all of us equally. Is this something that is not taught to those that claim to be ‘conservatives’?

All our politicians claim to be religious, yet with few exceptions, they seem to be unable to make statements containing facts instead of fiction. Is there some passage in the Bible that I missed that says something to the effect that if you’re running for office it’s no longer a sin to lie?

It might benefit our politicians to once again read Robert Fulghum’s essay “All I Really Need to Know I Learned in Kindergarten” and follow the rules.

For those with any degree of principles one of Fulghum’s latest comments from “What I Want” will definitely bring a smile.

“I want all candidates at Republican Party debates to be required to appear naked onstage so that at least some objective truth will be on offer”

Thoughts for the Day – March 12, 2012

Keystone XL Pipeline

The economy and jobs is the number one issue on the administration and the minds of voters. Does it really make any sense that the POTUS would delay the Keystone XL project without good cause knowing it should eventually create somewhere in the neighborhood of a total of 20,000, including jobs added to construction and manufacturing .

The number of permanent job s after construction is not nearly as impressive.

The DOS requested additional information on the route through Sand Hills, Nebraska from TransCanada on November 11, 2011 and our less-than-interested-in-the-needs-of-the-country congress responded to that request on December 23, 2011 by passing a law demanding a decision on Keystone, by the President, within 60 days. Since it wasn’t going to take 60 days to determine a decision couldn’t be made until the additional information requested was received, Secretary of State Clinton denied the Keystone XL Pipeline application of January 18, 2012.

Keystone is in the process of preparing a new Presidential Permit application. The Republicans are having a field day blaming President Obama for lack of jobs, higher gasoline prices, etc., which could all be solved by waving the Keystone XL Pipeline magic wand. I just don’t see it that way. The rules for Presidential Permit application approval was set up by former President George W. Bush through a series of Executive Orders. Not to mention when I hear the words oil pipeline my mind automatically reverts to the BP oil spill.

Alabama and Mississippi Primaries

The latest poll out shows Mitt Romney, Rick Santorum and Newt Gingrich all statistically tied for first place in these two primaries. I would love to see Mitt Romney beat out Santorum and Gingrich for the delegates in these states. On a comparative basis Mitt Romney is a man of honor and Santorum and Gingrich don’t even know how to spell the word – IMHO.

Communications from the Past and Present

Dating of three charcoal cave paintings located at The Cave of Chauvet – Pont -D’Arc, located in southeastern France indicates these drawings are approximately 31, 000 years old, making the drawings the oldest known cave paintings in the world.

These paintings were only discovered in 1994 by Jean-Marie Chauvet and two friends who are all interested in speleology [scientific study of caves] and the three have made numerous findings throughout the years.

This finding was even more amazing because of the location of the cave. Although the entrance is relatively high up on a mountain, it’s not very far from a popular hiking trail in the French countryside.

30,000 plus years ago we began communicating by drawing pictures on cave walls and never stopped introducing new forms of communications.

During the Roman Empire the earliest of messages were sent using metal to reflect the sun from one location to another.

Ships at sea signaled to one another by raising or lowering flags and/or firing cannons. American Indians communicated using both smoke signals and drums.

Paper was invented and we had wooden block movable type printing until such time as Johannes Gutenberg came along and developed a printing press with metal movable type. Paper was being produced from wood pulp making it more readily available and the newspaper was born and flourished.

The typewriter and photographs soon followed, along with the microphone. Samuel Morse invented Morse code and the first long distance electric telegraph line.

Pony Express was started for mail and newspaper delivery and a patent was issued for the first fax machine. The modern typewriter was invented along with the mimeograph machine [a copying machine]. Alexander Graham Bell patents the electric telephone. Edison patents the phonograph and high speed photography captures motion. By the mid 1920’s we had the first successful talking motion picture. It didn’t take long for radios and TV’s to follow.

By the early 1950’s computers were being sold commercially and once the microprocessor was invented in 1971, the door was pushed wide open for the electronic miracles that followed.

Cell phones, cell phone networks, Walkman’s, desktop computers, laptops, computer mice, CD Rom drives, DVD’s, satellite TV, Blue Ray, the list goes on and on and on.

When the United States relinquished control of the internet in 1994 and the World Wide Web was born, communications could be sent with lightning speed. If you can find it on the internet, you can usually share the file with your friends and family through e-mail, instant messaging, text messaging, video calling or by posting to YouTube, Facebook, Twitter or any number of other social networking sites.

Over the past several elections the internet has turned into a tool for savvy politicians. They’ve learned they can reach millions of voters at the right price and they can sway the voters with their promises, or in all too many instances, their lies. At one time the internet was “the source” for factual information, but when it comes to politics or political issues, you really have to be willing to search for the truth.

The internet has also become the place to find the perfect bumper sticker. Bumper stickers have been around as long as the Model T, but not readily available to the average voter. Now you can order your bumper sticker over the internet, at any number of places, and have it shipped directly to you. There have been a lot of ‘cute’ bumper stickers that have made their way onto our bumpers, or our windows, or wherever else you choose to display, but we don’t think there are any that even begin to compare with the following, which may also be a perfect example of some hanky-panky on the internet.

This particular bumper sticker is being advertised on a national retailer’s website as follows:

“I’ll Hug Your Elephant if you’ll Kiss My Ass”

Perhaps the change in wording is simply a typo and whether the word change is intentional or simply an error, the fact remains – when it comes to communications in this country – “We’ve come a long way Baby”.

Respect for Women is only a Vote Away

Even though I heard the words with my own ears, I still cannot believe Rush Limbaugh would say something so totally appalling. After five of his sponsors dropped him, he finally managed to apologize for his unacceptable behavior, but is it good enough?

IMHO – not in this lifetime!

Following is Rush Limbaugh’s, February 29, 2012, reaction to Sandra Fluke’s testimony.

“What does it say about the college co-ed Susan [Sandra] Fluke, who goes before a congressional committee and essentially says that she must be paid to have sex, what does that make her? It makes her a slut, right.” It makes her a prostitute. She wants to be paid to have sex.”

Limbaugh further stated:

“If we are going to pay for your contraceptives, and thus pay for you to have sex, we want something for it,” “We want you to post the videos online so we can all watch.”

How can you even begin to comment on statements made by someone that appears to be so unbelievably perverted?

Today former Speaker of the House Newt Gingrich is now throwing in his two-cents on the subject:

Newt Gingrich says it was “appropriate” for Rush Limbaugh to apologize to Georgetown University student Sandra Fluke for calling her a “slut,” but he slammed the news media for its focus on the talk show host’s words.

What did Sandra do to Rush Limbaugh to ever deserve his wrath? This young lady had the audacity to testify before a small group of congressional leaders on February 23, 2012. The reason she was testifying on February 23, 2012, while the majority of congressional members were on break, is due to the fact the request for her to speak before the Republican-controlled House Committee during their hearing had been rejected.

Sandra’s testimony was important because it shed light on the fact birth control pills go beyond being just contraceptives and are often used to treat the following medical conditions, when symptoms warrant:

· Polycystic Ovary Syndrome (PCOS)

· Endometriosis

· Amenorrhea

· Menstrual Cramps

· Premenstrual Syndrome (PMS)

· Heavy Menstrual Periods

· Acne

· Anemia

· Birth control pills can also lower the chance of getting endometrial cancer, ovarian cancer and ovarian cysts.

Sandra Flukes testimony was about a friend who had to have an ovary removed because her insurance would not cover the cost of the birth control pills needed to stop the growth of cysts.

This young lady had to have a section of her reproductive organs removed due to the fact the powers to be, controlling her insurance coverage, don’t believe in contraceptive pills. The young lady’s right to bear children may be forever terminated because certain people in this country feel contraceptives conflict with some religious beliefs.

Statistics indicate 99 percent of the women in this country, have, are, or will be using some form of birth control in their lifetime. If the churches were able to get their point across that contraceptives should not be used by members of their church, that percentage would obviously not be so high.

The failure of women to follow the teachings of their church is simply a failure of the church to get their message across, but has nothing whatsoever to do with women’s health issues.

The Patient Protection and Affordable Care Act, Public Law 111-148 eliminates co-pays on contraceptives as of August 1, 2012, just as it eliminates co-pays on other medical expenses.

The 51-48 U.S. House vote on Senate Amendment 1520, an amendment submitted by Senator Roy Blunt (R-MO) to Senate Bill S.1813 was defeated and that’s what all the hype is about. The “intent” of this bill was to “protect rights of conscience’ by allowing various employers and/or health plans to opt out of payments for services that conflict with their religious beliefs.

S. 1813 is a bill to reauthorize Federal-aid highway and highway safety construction programs and was introduced on November 7, 2011. S-1813 is what is known as a ‘jobs’ bill. If this bill ever passes it will be the first step towards putting people back to work in this country. In the interim, adding frivolous amendments to the bill, just wastes legislators’ time and taxpayer money.

The amendment starts off with a quote by Thomas Jefferson as follows:

(A) As Thomas Jefferson declared to New London Methodists in 1809, “[n]o provision in our Constitution ought to be dearer to man than that which protects the rights of conscience against the enterprises of the civil authority”.

That one sentence says it all “dearer to man”… hasn’t anyone bothered to tell our legislators that it’s no longer 1809 and women now have rights?

The rights didn’t come easy – some took until 2009. In 2007 the Republicans defeated the bill for equal pay for women. President Obama championed our right to receive equal pay for equal work and signed the Lilly Ledbetter Fair Pay Act of 2009 into law, P.L. 111-2

Remember one thing when November 6, 2012 rolls around. Republicans want to take away women’s rights, as can be determined by the other four bills that are pending against contraceptives and the incredible number of lawsuits floating about regarding the rights provided under Roe v. Wade. It is their hope that one of these bills will make it to the Supreme Court and Roe v. Wade will be overturned.

The Two S’s, Samuel Wright Bodman III and Solyndra

All of us recognize the name Solyndra as it became a favorite talking point of the Republicans and the media for criticizing President Obama.

The harm has already been done as the majority of Americans are under the impression the Obama Administration showed favoritism to Oklahoma billionaire, George Kaiser by approving the Solyndra loan. Kaiser is a wealthy investor with Democratic ties.

Supposedly when an allegation is made in this country, the person is considered innocent until proven guilty, yet when it comes to politics just the opposite appears to ring true.

In this instance President Obama was found guilty of squandering taxpayer money to the tune of $535 million dollars by guaranteeing a loan to Solyndra. President Obama was found guilty in the public eye without all the facts being presented.

Let’s try looking at the Solyndra debacle without unnecessary innuendo and allegations.

On August 8, 2005 President George W. Bush signed the Energy Policy Act of 2005, P.L. 109-58 into law. The purpose of this law was to promote clean energy. Because clean energy is a ‘good thing’, the provisions of P.L. 109-58 were incorporated into The American Recovery and Reinvest Act of 2009, P.L. 111-5 signed into law by President Barack H. Obama on February 17, 2009 in an effort to create new jobs in the U.S.

From the period of January 31, 2005 through January 20, 2009, Samuel Wright Bodman III was the United States Secretary of Energy under President George W. Bush.

The Solyndra application was originally submitted to the Department of Energy in 2006 and during the period from 2006 through 2008 the application was given due process and by the end of 2008 Solyndra was considered to be the most advanced project and the likely recipient of the very first loan guarantee. By the time President Obama came on the scene the staff at DOE had already established a date of March 2009 for issuing a conditional loan guarantee commitment to Solyndra.

Naturally when President Obama came on board further review was given to the commitment and by September 4, 2009 it was announced the Department of Energy had finalized a $535 million dollar loan guarantee for Solyndra, which manufactures cylindrical solar photovoltaic panels providing clean, renewable energy.

In my opinion, the Solyndra failure wasn’t really a company failure, but a drastic change in the global market place.

U.S. market share on manufactured solar cells and modules sold around the world dropped from 40 percent to 6 percent, with China’s market share jumping from 6 percent to 54 percent. But, why wouldn’t China’s market share increase tremendously? In 2010, alone, China provided $30 billion in subsidies to its solar manufacturers.

Solyndra had four Chinese competitors which sold polysilicon panels. Polysilicon prices dropped significantly allowing these Chinese manufacturers to drop their prices by huge margins and they were simply able to undercut Solyndra on the pricing. About the same time, Europe began having its own economic problems and sales dropped further.

Solyndra took the actions necessary to increase sales and marketing, while cutting costs and revenues did increase 40% between 2009 and 2010, but the efforts left Solyndra short on capital and bankruptcy was inevitable if it was unable to secure new financing. Unsuccessful in their attempts to secure new financing Solyndra entered into bankruptcy proceedings in September of 2011.

Solyndra was the very first loan guarantee and unfortunately it failed, but the only other failure, to date is Beacon Power for $43 million. These two defaults represent approximately 1.7 percent of total allocations, which is an incredibly small percentage for failures.

Whether the loss will go down in the history books as belonging to the administration of George W. Bush or the administration of Barack H. Obama isn’t the issue. At issue is the bitterness exhibited towards this president by members of the opposing party.

When Senator Mitch McConnell made the following statement he was speaking for Republicans in general. “The single most important thing we want to achieve is for President Obama to be a one-term president”.

Our country is in trouble and the priority should be getting the economy turned around and getting people back to work, not seeing how much criticism you can direct towards the person holding the highest position in the country.

Crude Facts about Crude Oil 2012

If you’ve filled up lately you know for a fact the retail price of $3.38/gallon in January 2012 isn’t even close to what we’re paying in February of 2012. The average retail price for February 20, 2012 has jumped to $3.59/gallon and will continue to go up.

Why does the cost of gasoline fluctuate so much in this country?

The simple reason is the law of supply and demand. In 2010 we produced 5.5 million barrels of crude oil per day, while our petroleum consumption exceeded 19.1 million barrels per day. We are the world’s largest petroleum consumer at 22 percent.

That basically means we have to import a significant portion of crude oil and petroleum products.

In 2010 our imports came from the following sources:

· Canada (25%)

· Saudi Arabia (12%)

· Nigeria (11%)

· Venezuela (10%)

· Mexico (9%)

According to the EIA there are at least seven factors that have an effect on imported crude oil prices as follows:

· Supply: Non-OPEC

· Supply: OPEC

· Balance: OECD inventories & WTI futures spread

· Spot Prices:

· Financial Markets:

· Demand: Non-OECD

· Demand: OECD

Chart data on the above items are updated monthly and/or quarterly.

Fear is a significant force when it comes to crude oil pricing. Concerns about Iran halting oil shipments to the UK and France sent Brent crude oil prices soaring to the highest level in nine months. On February 23, 2012 oil futures closed at $107.83, which is up $9.73 from a year ago.

Although the price of crude oil has increased significantly, a significant portion of the recent increased cost in a gallon of gasoline appears to be due to domestic problems.

On December 1, 2011 Sunoco, Inc. announced that due to deteriorating market conditions (translated I think that means their profit was lower than expected), they were going to shut down their Marcus Hook, PA refinery immediately while it seeks a buyer.

Sunoco also has plans to sell its Philadelphia PA refinery and are planning on closing this facility by mid-2012. If ‘market conditions’ warrant, they will be closing sooner.

ConocoPhillips has also announced its intent to idle its Trainer Pennsylvania refinery, also located in southeastern Pennsylvania.

These three refineries are all in PADD 1 and in 2010 comprised more than 50% of the total refining capacity in the Northeast.

The West Coast is also having refinery problems. A week ago a fire at the BP Cherry Point 225,000 bpd refinery in Blaine, Washington shut the refinery down for at least three weeks. This refinery represents 8.7 percent of the crude oil refining on the West Coast.

We could have all the crude oil in the world, but if we don’t have operational refineries we’re going to pay the price at the pump.

The United States has a total of 148 operational refineries, but only 137 are operating as 11 are idle.

Super PAC’s, the 2012 Election and You

What happened at the Iowa caucus?

Poll after poll showed Mitt Romney leading the pack prior to the January 3, 2012 caucus with Ron Paul in second place and Rick Santorum in third place, at times trailing by double digits.

On December 28, 2011, five days prior to the caucus, Rasmussen Reports conducted a telephone survey of likely caucus participants which indicated Mitt Romney in first place, Ron Paul in second place and Rick Santorum in third. This was the third week in a row that indicated Mitt Romney was ahead. Rasmussen’s commentary on this survey indicated he felt a high turnout on caucus night would give Mitt Romney an even bigger win. As it turned out there were a record number of voters attending the Iowa caucuses, but a different winner.

On January 4, 2012 Mitt Romney was declared the winner by an eight vote margin, but by January 19, 2012 GOP party officials announced new results declaring Rick Santorum ahead by 34 votes. How did Iowa go from a sure-win for Mitt Romney to a win for Rick Santorum?

It’s possible the answer can be found in the District of Columbia’s Court of Appeals March 2010 decision on SpeechNow v. FEC This decision is similar to the U.S. Supreme Court decision in January of 2010 on Citizens United v. Federal Election Commission Where Citizens United gave corporations the right to spend unlimited funds on candidates in federal elections; the SpeechNow decision gave individuals the same rights and the flood gates were opened for political spending in the form of IE’s – independent expenditures.

IE’s are also known as super PAC’s (political action committees) and they are allowed to take in unlimited contributions and spend unlimited amounts of money for the sole purpose of electing or defeating a federal candidate as follows:

An independent expenditure is an expenditure for a communication "expressly advocating the election or defeat of a clearly identified candidate that is not made in cooperation, consultation, or concert with, or at the request or suggestion of, a candidate, a candidate’s authorized committee, or their agents, or a political party or its agents." 11 CFR 100.16(a).

There are three separate types of Independent Expenditure groups as follows:

Iowa voters were bombarded with e-mails, online ads, robocalls, newspaper ads, radio ads and TV ads during the 10-day period prior to the January 3, 2012 caucuses – all in support of candidate Rick Santorum from the following two super PAC’s.

Two separate IE committees, Red, White and Blue Fund and Leaders for Families Super Pac, Inc. brought in total donations in the amount of $879,985.00. The majority of these donations came from two separate individuals. Foster Friess donated $381,000 while Dr. John Templeton donated $250,000. An additional $75,000 was donated to Leaders for Families Super Pac from the Red, White and Blue Fund.

In other words more than 80% of the total donations came from one of three places – two individuals and one super PAC.

How does the average voter even begin to compete with billionaires, millionaires, large corporations and unions in expressing preference for one candidate or another?

Red, White and Blue Fund and Leaders for Families Super Pac, Inc. are only two super PAC’s that are advocating Rick Santorum for President.

As of February 25, 2012 there were 320 Independent Expenditure Filers registered with the FEC for the 2012 election.

How many primaries are going to be bought by these Independent Filers for their candidate of choice?

Another Look at ‘First in the Nation’ Caucus Results from Iowa

The Iowa Caucus is always conducted on January 3 of a presidential election year and consists of four parts as follows:

(1) The Caucus Chairman holds a Presidential Preference Poll.

(2) Nominations are taken and an election is held for “precinct committee leaders”.

(3) Delegates are elected to the Republican County Convention.

(4) Platform issues for the Republican Party are submitted and discussed.

Although delegates are selected at various steps in the process, i.e.; the January 3, 2012 Caucuses, the March 10, 2012 County Convention, and the April 21, 2012 District Convention, the actual delegates to the Republican National Convention are not selected until the Iowa State Convention which is held on June 16, 2012.

Iowa may be first in the Nation for Presidential Preference polling, but they don’t seem to be real quick on the draw when it comes to actually casting a vote. Votes cast during caucus polling, as well as other steps along the way, are simply not binding and delegates can vote for whatever candidate they choose.

Once the Presidential Preference polling votes are counted they are submitted to the Republican Party of Iowa and the initial results are then provided to the media.

The initial results from the January 3, 2012 caucus indicated Mitt Romney as the winner with a thin margin of 8 votes, but by certification date, the count had changed.

On January 19, 2012 a statement was released by the Iowa Republican Party indicating Iowa had certified vote totals in 1766 of 1774 precincts with Rick Santorum having a vote count of 29,839, Mitt Romney receiving 29,805 votes, Ron Paul receiving 26,036 votes and Newt Gingrich receiving 16,163 votes.

The total of 121,503 certified votes for the 1766 precincts represents a record breaking number of people attending the caucuses, but due to the fact the vote was so close, and Form E’s were missing from several precincts; we’ll never really know who won the Iowa Caucuses.

The eight precincts that were missing Form E and were not included in the certified count are as follows:

If you have 1774 precincts and only count the results in 1766 precincts can you really declare a winner?

On January 31, 2012 Matt Strawn, the Chairman of the Republican Party of Iowa resigned.

What is interesting about the Iowa Caucus is the opinion change from one week to the next. One week before the caucus polls Mitt Romney had a huge lead over Rick Santorum, yet according to the numbers presented, Rick Santorum came out on top.

What happened in that last week to cause Iowa voters to prefer Rick Santorum over Mitt Romney?

We can find the answer to that question by going back to the decisions made by the United States Supreme Court in 2010. The decision on Citizens United v. FEC gave corporations the right to donate and spend unlimited amounts of money on federal elections, while the SpeechNow decision gave individuals the same right.

Back on Track

Less than two months after President Obama took office, on March 9, 2009, the DJIA hit a low of 6,547 points due to what would soon become known as the Great Recession, started in 2008. This morning the DJIA hit the 13,000 point once again which means the DJIA has basically doubled under this president. The DJIA may not stay above 13,000 as it fluctuates minute to minute based on current happenings, but the fact is, once again it is headed in the right direction.

Thank you President Obama.

My Opinion of Bill O’Reilly’s Comments about Whitney Houston

Why are we, as a nation, so quick to judge others?

Bill O’Reilly has once again stuck his foot in his mouth by claiming Whitney Houston killed herself with drugs.

I must have missed something because I did not realize Bill O’Reilly was a certified medical examiner and had the opportunity to investigate Ms. Houston’s death. The fact is, he isn’t a certified medical examiner and since the professionals have not had the opportunity to rule on the cause of Ms. Houston’s death, Mr. O’Reilly should keep his opinions to himself.

Even if it turns out that her death was caused by an overdose of drugs, the drugs that were found in her hotel room are prescription drugs, not street drugs. O’Reilly is making it appear that Ms. Houston intentionally took her own life by abusing drugs, and there is no factual evidence to prove that is the case. Unfortunately, Fox News commentators are known for their history of reporting opinions v. facts.

When I think of Whitney Houston I think of a beautiful lady that was incredibly talented with a voice that will be hard to match.

I also think of her 18-year old daughter, and her elderly mother. Whitney Houston has gone to a better place and Bill O’Reilly’s comments can no longer hurt her, but they can cause a tremendous amount of unnecessary grief to the loved ones she left behind.

Making the statement that someone that has abused drugs in the past is trying to commit suicide is ignorant.

If a person with Diabetes eats a piece of cake are they trying to kill themselves? If a person with a heart condition overexerts herself/himself are they trying to kill themselves? If a combat veteran comes back from war and takes drugs and alcohol to help them sleep at night are they trying to kill themselves? If a person diagnosed with a long-term illness refuses treatments are they trying to kill themselves? If a person that’s obese continues to eat fattening foods are they trying to kill themselves? If a person with a lung disease continues to smoke are they trying to kill themselves? If an alcoholic falls off the wagon and has a drink are they trying to kill themselves?

All of us have skeletons in our closet, even Bill O’Reilly. We would be much better off, as a country, if we spent less time criticizing others and more time attempting to provide those in need with the support necessary to overcome their demons.

Whitney Houston had a life that was fraught with some periods of unrest. It’s now time to allow the lady, and her family, to Rest in Peace.

THE GOLD BOX

The story goes that some time ago a mother punished her five year old daughter for wasting a roll of expensive gold wrapping paper.. Money was tight and she became even more upset when the child used the gold paper to decorate a box to put under the Christmas tree.

Nevertheless, the little girl brought the gift box to her mother the next morning and then said, ‘This is for you, Momma.’

The mother was embarrassed by her earlier over reaction, but her anger flared again when she opened the box and found it was empty. She spoke to her daughter in a harsh manner.

‘Don’t you know, young lady, when you give someone a present there’s supposed to be something inside the package?’

She had tears in her eyes and said, ‘Oh, Momma, it’s not empty! I blew kisses into it until it was full.’

The mother was crushed. She fell on her knees and put her arms around her little girl, and she begged her forgiveness for her thoughtless anger.

An accident took the life of the child only a short time later, and it is told that the mother kept that gold box by her bed for all the years of her life.

Whenever she was discouraged or faced difficult problems she would open the box and take out an imaginary kiss and remember the love of the child who had put it there.

In a very real sense, each of us, as human beings, have been given a Golden box filled with unconditional love and kisses from our children, family and friends… There is no more precious possession anyone could hold.

Friends are like angels who lift us to our feet, when our wings have trouble remembering how to fly.
