Should Limits Be Placed on the Number of Organ Transplants an Individual receives in their Lifetime?

Sarah Murnaghan is the young lady with Cystic Fibrosis (CF) whose parents, Janet and Francis Murnaghan, filed a motion on June 5, 2013 in the Pennsylvania Eastern District Court against the United States Department of Health and Human Services. The motion (Case Number: 2:2013cv03083) requested a temporary injunction against application of the Under 12 Rule, allowing 10-year-old Sarah Murnaghan to be considered as a recipient of an adult lung transplant due to the severity of her condition.

A temporary restraining order [TRO] was approved by the court against the Department of Health and Human Services allowing Sarah’s name to be placed on the adult transplant list and Sarah Murnaghan underwent a double lung transplant on June 12, 2013 at Children’s Hospital of Philadelphia. Within hours of receiving the transplant Sarah’s lungs failed.

Two lungs, that could have saved other lives, were simply wasted on June 12, 2013 on Sarah Murnaghan. I say wasted because Sarah suffers from Cystic Fibrosis, an inherited disease that affects not only the lungs, but the digestive tract as well as other areas of a person’s body. It is a life-threatening disease caused by a defective gene which is passed down through the family.

Although millions of individuals carry the CF gene, the only way a person can actually become ill with Cystic Fibrosis is if each one of the parents carry the defective gene. In Sarah’s case, both parents’ genes are defective causing the “deadly” disease.

A person can live with only one lung, as indicated by our new Pope and numerous others. Pope Francis had one of his lungs removed when he was a teenager due to an infection. Many individuals have had a lung removed due to infections, tuberculosis and cancer and go on to lead healthy lives.

As long as I can recall I have had lung problems and although I don’t remember much about my childhood, I do remember gasping for breath when I was a young child, so I can certainly empathize with Sarah’s condition, but I am also an organ donor and as such do not feel the court’s ruling against the DHHS was, in any way, warranted. The Under 12 Rule was put in effect for a reason and Secretary Sebelius made the correct decision in requesting a review.

There are too many individuals in this country that need organ transplants for the court to basically play “God” and decide who is going to be provided with the opportunity to live and who isn’t.

Since Sarah’s lung transplant on June 12th failed, her name was added to the transplant list and the young lady received another double lung transplant on June 15, 2013. Sarah is now scheduled for another surgery on Monday, July 1, 2013 due to the fact she is suffering a complication from the second transplant surgery and was put back on a ventilator due to partial paralysis of her diaphragm.

The surgery scheduled for July 1, 2013 is an effort to repair her diaphragm.

How much suffering should this poor child be forced to endure due to the fact courts have decided they know more than medical professionals?

When all is said and done will we have two wasted lungs that could have been actually used to save other people’s lives, or will we have three or four? Or will more lungs be lost on this one child?

How many lungs will be lost before ignorance is replaced with common sense?

REVIEW – Cabela’s Commercial Grade 11 Pound Vertical Stuffer

The Stuffer comes in a box weighing 27 pounds and is basically already assembled. The only items that are not already attached are the handle, which is easily installed simply by attaching to one of the two nuts on the side of the stuffer and the stuffing tubes. The stuffing tubes come in the following sizes 10mm, 20mm, 30mm and 40mm and are easily installed by taking a nut off and putting it back on.

The handle has both a slow and a fast speed depending upon which of the two nuts you connect it to. The faster speed is great for use with the plunger, while the slower speed is good for stuffing.

Basically everything you need to make sausage is included the box other than whatever type of meat you are planning to use and whatever means of storage you use.

I decided I would make Italian Sausage and to that end I purchased a Cabela’s kit for making 25# of sausage. The kit included all the spices, plus casings.

In addition, I purchased the following additional items, distilled water – the kit called for using distilled water, a package of Cabela’s ground meat freezer bags, a pair of hog casing pliers for closing the bags/casings with hog rings, a box of hog rings, a box of disposable gloves and most important a can of food grade silicone spray.

We set aside the amount of pork required and went to town. We made two and ½ batches of sausage to process the 25# of meat, and it was really a very simple process.

We put the pork in a bowl, added the proper amount of seasoning mix and distilled water, then mixed by hand for several minutes until thoroughly mixed.

Before placing the mixture in the stuffer make sure you spray all internal parts of the stuffer with the silicone spray in order to make it easier to work with whatever type of meat you are using.

Once you get the meat in the stuffer (which holds approximately 11 pounds of meat at one time), you simply install the stuffing tube of choice and turn the handle.

In addition to casings, we also used Cabela’s ground meat freezer bags and the entire process was a piece of cake. You simply turn the handle and the bag which probably holds two pounds of meat fills up in a flash, then you simply twist the top of the bag and securely close the bag with the hog casing pliers, which are also extremely easy to use.

There were three of us working on this project, my wife, our neighbor and myself and in far less than two hours we had all the sausage made, put away and everything cleaned and put away.

Cleanup was also a piece of cake. All moving parts are removable and can be cleaned in a flash.

If someone is interested in making any type of sausage this product is superior due to ease of use and is highly recommended by me.

“Now is the time…” aka The Birth of the Typewriter

One of the SearchWarp authors mentioned the term “Now is the time for all good men to come to the aid of their …” in their bio and the quote immediately caught my attention due to the fact it was different from what I learned in typing class.

The writer was taught the following: “Now is the time for all good men to come to the aid of their party” while the version I learned is “Now is the time for all good men to come to the aid of their country.”

I began writing with three questions in mind. Where the term did come from, when was it changed and why was it changed? I’m sorry to say that after numerous hours of research I only have the answer to one question – where the term came from, but the story is interesting enough to want to share.

If you Google the term “Now is the ….” you’ll see many references to Charles E. Weller as the author of the phrase, but that’s an incorrect assumption on the part of the writers. Charles E. Weller was in the room when the words “Now is the time for all good men to come to the aid of the party” were first uttered, but he was not the originator.

In 1918, while Secretary of the National Shorthand Reporters’ Association, Charles E. Weller wrote the book “The Early History of the Typewriter”. In his book, he explains that while he was employed as the Chief Operator of the Western Union Telegraph Company located in Milwaukee Wisconsin, Christopher Latham Sholes came to the telegraph office to request a piece of carbon paper. At the time carbon paper was used by the telegraph office to make duplicate copies of Associated Press reports received for the press, but seldom used anywhere else.

This was sometime during the month of July 1867. As Sholes was leaving the office with his piece of carbon paper, he asked Weller if he would be interested in coming over to his office the next day around noon, as he had something interesting to show him.

The next day Weller went over to the Federal building where Sholes currently held the position of Collector of the Port of Milwaukee and found him with Carlos S. Glidden discussing the small mechanical unit on the table in front of them. The unit had a bar with the letter ‘w’ cut into it, a piece of glass, as well as other parts and a Morse telegraph “Key” attached in such a manner that if you held a piece of carbon paper and a thin piece of white paper against it and tapped the Morse key repeatedly, a perfect line of w’s would appear as follows: wwwwwwwwwwww

At the time the only form of printing that was known was the extremely slow process of typesetting so it was amazing to see the line of w’s printed evenly across the page with so little effort.

Sholes explained to Weller and Glidden how adding more bars with letters cut in the ends could eventually allow the operator to ‘type write’ the entire alphabet, at the time a difficult concept for both Weller and Glidden to comprehend.

Glidden, a fellow printer, along with Sholes became interested in the design and manufacture of the machine and the two eventually teamed up with Samuel W. Soule, a machinist. The three of them worked on the design of the machine at 318 State Street in Milwaukee, in the machine shop of C.F. Kleinsteuber and by late fall of 1867 the first working type writer was completed and ready to be tested for speed by repeatedly typing the same sentence over and over again.

Weller doesn’t indicate in his book which of the three men, Sholes, Glidden or Soule came up with the test sentence “Now is the time for all good men to come to the aid of the party” but he does mention there was an ‘exciting political campaign’ going on at the time. Sholes in addition to having been the former publisher of the Kenosha Telegraph was also a politician and had served in both the Wisconsin State Senate and the Wisconsin State Assembly so it’s entirely possible he may have coined the term, or it may very well have put together piece-meal by all three men.

That was the beginning. The term was subsequently changed to “Now is the time for all good men to come to the aid of their party” and “Now is the time for all good men to come to the aid of their country“, to the current version “Now is the time for all good men and women to come to the aid of their country.”

On June 23, 1868, Sholes, Glidden and Soule were issued U.S. Patent No. 79265 [which has no resemblance to the final product] and spent the next year perfecting their ‘type writting machine’. By September of 1969 the first practical typewriter was operational and due to the fact funds were running low Sholes wrote a letter to James Densmore explaining the potential of the machine. Without Densmore ever seeing the unit Sholes negotiated selling Densmore a 25% interest in the invention in 1870 in order to cover future development costs.

When major corrections were made a unit would be shipped to Weller, who had subsequently moved to St. Louis, Missouri. Weller would test the new unit and send his findings back to Sholes, who would then incorporate Weller’s suggestions into the design as well as adding additional upgrades.

Several times Sholes wrote to Weller explaining he thought he had finally perfected the machine, only to write back several months later explaining new changes were being incorporated and this process went on for several years.

Finally, on April 30, 1873 Sholes wrote a letter to Weller explaining he was finally satisfied with the machine and a contract had been signed with Remington Arms Company, Ilion New York to manufacture 1000 units.

While Sholes was the genius behind the invention Densmore was the person that received the majority of financial gains from the invention by eventually obtaining controlling interest in the product and selling to E. Remington and Sons.

Although different versions of a typewriter have actually been around since the early 1700’s the Sholes typewriter is the only one that became a commercial success. It’s also the only typewriter that contained the QWERTY layout still used today on all keyboards. QWERTY refers to the first six letters on the left side of the keyboard.

Born on Valentine’s Day, Charles Latham Sholes died a poor man on February 17, 1890 at the age of 71, and was buried at Forest Home Cemetery in Milwaukee, Wisconsin. He died with so little money that a marker was not even purchased for his grave.

The Nineteenth annual convention of the National Shorthand Reporters’ Association was held in Cleveland, Ohio on August 13, 1917, ninety-eight years after the birth of C. Latham Sholes. At that convention a resolution was made and unanimously carried by the members to set up a system of soliciting contributions for the purpose of erecting a monument to C. Latham Sholes at his gravesite.

Whether or not they succeeded on their own in obtaining the funds, or if donations were received by other organizations, I don’t know, but what I do know is there is a beautiful monument erected at his gravesite giving homage to the inventor http://www.findagrave.com/cgi-bin/fg.cgi?page=pv&GRid=7656870&PIpi=2795520

When Too Much is not enough

Whether or not someone is ‘too rich’ in monetary terms can only be determined based on what that particular individual does with his/her wealth.

Warren Buffet, Chairman and CEO of Berkshire Hathaway is considered to be the 4th wealthiest individual in the world, and the 2nd wealthiest in the United States. His net worth is estimated at $53.5 billion on the Forbes 2013 listing of the wealthiest individuals in the world.

Warren Buffet was probably the first person to bring the U.S. tax cut problems to light by appearing before the U.S. Senate Committee on Finance on November 14, 2007. It was during this hearing that Mr. Buffet proved, beyond a reasonable doubt, the gap between the super-rich and the middle class in the United States had widened tremendously due entirely to the tax law changes benefiting the rich, put into place under the Bush Administration. He basically compared the increase in the Forbes 400 list with the median income increase for the average American over a 20 year period of time. During this hearing Mr. Buffet stated that while the average American workers income has been on a treadmill, income for the super-rich has been on a spaceship.

That same year Warren Buffet appeared at a New York fundraiser and said he was taxed at a rate of 17.7% of the $46 million he earned in the last year, while his secretary was taxed at 30% on the $60,000 she earned.

Warren Buffet’s August 2011 opinion piece published in the New York Times “Stop Coddling the Super- Rich” explains some of the tax cuts available to the wealthy, that aren’t available to the average taxpayer. If you haven’t had the opportunity to read this article, you may want to take a few minutes to review as it will provide a better understanding of tax cut problems.

The following Warren Buffet quote basically says it all: ““There’s class warfare, but it’s my class, the rich class, that’s making war, and we’re winning.”

Although he’s the second wealthiest person in the United States Warren Buffet apparently still resides in the same home he purchased back in 1958 for $31,500, although it appears he does own a home in California estimated at $4 million dollars. His frugal nature was obvious when it came time to purchase a new corporate jet for Berkshire Hathaway. While most CEO’s would order a shiny, new jet, Buffet settled for a “used” model.

His salary from Berkshire Hathaway is a measly $100,000/year – a mere pittance when compared to others in his position.

In June of 2006 Buffet made the largest charitable contribution in history [approximately $30.7 billion] to the Bill and Melissa Gates Foundation. This was the first step in his plan to give his fortune to charity. The Gates Foundation receives 5% of the total contribution on an annualized basis every July beginning with July of 2006. The condition attached to this contribution was the Gates Foundation, beginning in 2009, must give away an amount equal to the prior year’s gift from Buffet, plus 5% of the foundation’s net assets.

Too many foundations are set up to avoid paying taxes and while they accept donations, fail to pass on those donations to worthy causes. The condition Mr. Buffet included in his plan eliminates that possibility.

There are numerous millionaires and billionaires in this country that definitely have an excessive amount of wealth and the reason it’s excessive is simply due to the fact very little good comes out of their assets. Warren Buffet definitely does not fall into that category. He is a prime example of how an excessive amount of wealth can be good for both the country and the people in it.

Too Many Companies to List

It wasn’t that many years ago I remember having a discussion with the manager of our local box store. I’d gone into the store to pick up some cards and come to find out they didn’t carry any. I’d like to say this was 50 or 60 years ago, but it wasn’t, it’s only been in the last 10 years. I absolutely could not believe this store had a card celebrating every holiday known to mankind, but didn’t have one, not a single card celebrating this particular day.

When I came home that evening I remembered I had just received a new catalog from one of the mail order houses and I thought, super, I’ll just order something from them so I went through the catalog from beginning to end only to be disappointed once again. This time I sent a complaint to Customer Service and was advised by return e-mail they would refer my complaint to someone else as they simply had not received any requests for the items I wanted.

“Items I wanted” – the words kept repeating themselves over and over in my head. I wasn’t looking for anything that “I” personally wanted; I was looking for something that should have been available at every single store in the nation, in various shapes, colors and sizes. I was looking for a Veteran’s Day card. Generally I make my own greeting cards, but this particular year I wanted something a little ‘different’.

I had attempted to purchase Veteran’s Day cards before, but this was after we went to war with both Afghanistan and Iraq and I thought okay, this is the year. This is the year the dingbats running the show will finally recognize the sacrifices being made and acknowledge our veterans.

For as long as I can recall I have always made Veteran’s Day special for my husband by making a favorite meal, or buying a little cake or just purchasing a little gift. Just something to let him know we remembered the day and were thankful for his service to our country.

According to the Veteran Population Projection Model 2011, as of September 30, 2012 there are 22.3 million veterans projected to still be living, broken down as follows:

Thankfully, the past five years have seen a major turnaround in how retailers view vets. Many major restaurants and stores are recognizing the need to honor both our Veterans and our active military personnel by offering discounts and freebies, not only on Veteran’s Day, but sometimes throughout the year.

I want to say that Golden Coral was the first to provide a free meal to veterans and Applebee’s was second, but I don’t have any way of proving that so I’ll just say they both took the lead. Since then numerous others have jumped on the bandwagon; especially within the past few years. A partial listing of participants in 2012 activities follows:

A partial listing of stores that offered a Veteran’s Day discount in 2012 also follows: Home Depot, Lowe’s and Big Lots. In addition discounts were provided at hotels, for car wash’s, for haircuts, oil changes and at various recreational facilities.

In most instances there are restrictions. Some restaurants offer the meals on Veteran’s Day only, some during the entire weekend, and some for only a few hours on a specific day. Check with your local restaurant for dates, times and individual requirements necessary for ‘proof of service’.

Do I love the companies listed above? You betcha! Our Veterans make sacrifices every day they are in service and in some instances, every day of their return. I would be thrilled if they just put a flyer in the window saying “Thank You” and wishing these men and women a happy day, but these companies go above and beyond and actually try to do something to make a difference, if only for one day.

Veteran’s Day is a Federal holiday and children are off school for the day and many businesses are closed down for the day, but too few people actually celebrate the day by giving thanks to those that served.

Article 1, Section 8 of the United States Constitution provides the following protection to individuals providing original works of authorship in the form of a copyright, patent or trademark.

“To promote the Progress of Science and useful Arts, by securing for limited Times to Authors and Inventors the exclusive Right to their respective Writings and Discoveries;” [1]

Protections under the various laws are so wide in scope that I’m only going to address two of the eight copyright provisions [“Literary works” and “Pictorial, graphic and sculptural works”] and not address patents or trademarks at all, other than with the following explanation:

Patents protect inventions and discoveries, while a trademark protects a specific word, phrase, symbol or design of goods or services belonging to one particular party.  Example – First-ClassTM and Forever StampTM are both trademarks of the United States Postal Service.

Copyright protection applies to the following eight items:

 Literary works;

“Literary works” are works, other than audiovisual works, expressed in words,

numbers, or other verbal or numerical symbols or indicia, regardless of the nature

of the material objects, such as books, periodicals, manuscripts, phonorecords,

film, tapes, disks, or cards, in which they are embodied.

  •  Musical works, including any accompanying words;
  •  Dramatic works, including any accompanying music;
  •  Pantomimes and choreographic works;
  •  Pictorial, graphic, and sculptural works;

“Pictorial, graphic, and sculptural works” include two-dimensional and three dimensional works of fine, graphic, and applied art, photographs, prints and art reproductions, maps, globes, charts, diagrams, models, and technical drawings,including architectural plans.”

Articles you create are protected by copyright laws the moment they are written and printed or copied, the actual rule follows:

“Copyright is secured automatically when the work is created, and a work is “created” when it is fixed in a copy or phonorecord for the first time.  “Copies” are material objects from which a work can be read or visually perceived either directly or with the aid of a machine or device, such as books, manuscripts, sheet music, film, videotape, or microfilm.”

Although the copyright symbol is no longer required under U.S. law, it is advisable to indicate on your original publication the copyright sign ©, year of first publication and author name as follows:

U.S. copyright laws also apply to works that are created outside the U.S.  if one of seven conditions is met.  One of the conditions follows:

“The work is first published in the United States or in a foreign nation that, on the date of first publication, is a treaty party.”

“A treaty party is a country of intergovernmental organization other than the United States that is a party to an international agreement.”

What does all this mean to you?  As you can readily tell by wandering around the internet, it means virtually nothing to the majority of individuals.  People are violating copyright laws every day of the week, and simply not realizing they are breaking the law.

Does ownership of a copyrighted book or manuscript give you permission to incorporate that material into your writings?  The answer is a definite ‘no’.  Owning the book simply means that you either purchased the book or it was given to you as a gift.   The author of the book retains copyright ownership until such time as it is transferred to another individual or entity.

If you quickly review this page you’ll see I’ve inserted data from other sources into this article.  You can insert data into your article as long as you have “permission” to do so.   Permission is granted by contacting the copyright holder and requesting permission to add this, this or this to your article.  If the copyright holder grants permission you may insert the material, if they don’t, you cannot because you will be in direct violation of copyright laws.

You may also use any material that is considered in the Public Domain, which would cover any material that was never copyrighted; the copyright has expired, or the material was written before copyright laws were in place.  The Bible is sometimes used as an example of a publication that was written before copyright laws; but certain translations of the Bible do hold a copyright.

The expiration of the copyright varies depending upon what state the material was created in and what state the material will be used in.

Fair Use  

17 U.S.C. 107 deals with the Fair Use of copyright material in particular situations, such as criticism, comment, news reporting, teaching, scholarship, and research, with the following four factors taken into consideration to determine whether or not a use is “fair” [3]

(1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;

(2) the nature of the copyrighted work;

(3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and

(4) the effect of the use upon the potential market for or value of the copyrighted work.

Determining what is fair use in any particular instance is not an easy task because there are no specific numbers of words or lines that may be taken from copyrighted material without permission.  The safest course of action to follow is to obtain permission from the copyright owner being using any copyrighted material.

Copyright Registration

The purpose of copyright registration is to provide a public record of the copyright.  The U.S. Copyright office receives more than 600,000 applications for copyright registration each year.

Three things are needed for copyright registration, a completed application, a nonrefundable filing fee and a nonreturnable copy of the work being registered.  Once your application is reviewed by the copyright office you will either receive a certificate of registration or a communication indicating more information is needed and/or a denial of the application along with a letter why it was denied.

Although I’ve written a fair amount on this subject, I’ve barely scratched the surface because of the fact that copyright laws are so complex.

Circular 92 is a 366-page PDF file, published in December of 2011, that outlines the” Copyright Law of the United States and Related Laws Contained in Title 17 of the United States Code”{2}  Any questions you may have on U.S. copyright laws will be answered in this publication.

In the Know – Square Brackets

My husband brought the mail in this afternoon and I was surprised to see an envelope from U.S. Senator Rand Paul (R-KY). I receive a lot of ‘political type’ mail but what was so unusual about this envelope is it was addressed to my husband.

Curiosity got the best of me and as I looked at the envelope further I could literally feel my blood pressure rising at an unprecedented rate. On the front of the envelope was the following statement, in size 18 font:

“IN THE COMING WEEKS, I WILL USE WHATEVER POWER THIS OFFICE HOLDS [TO BAN GUNS].” ~PRESIDENT BARACK OBAMA

When you are quoting someone it is permissible to insert your own comments [in brackets] to make it easier for the reader to understand the quotation.  In this illustration the inserted words were “To Ban Guns”, which were simply not spoken by the President.  It is also customary when you leave words out of a quote to indicate the omission with the following … the ellipsis [three equally spaced points] indicates to the reader that the quotation is not complete.

The inserted text was not meant to make the material easier to read, but to distort what was being said by the President of the United States.

The words used were taken from President Obama’s December 16, 2012 speech at the memorial service for the victims of the Newtown Connecticut massacre. The entire paragraph reads as follows:

“In the coming weeks, I will use whatever power this office holds to engage my fellow citizens — from law enforcement to mental health professionals to parents and educators — in an effort aimed at preventing more tragedies like this.  Because what choice do we have?  We can’t accept events like this as routine.  Are we really prepared to say that we’re powerless in the face of such carnage, that the politics are too hard?  Are we prepared to say that such violence visited on our children year after year after year is somehow the price of our freedom?”

Who would have the audacity to intentionally distort comments from a memorial service for children – why none other than our own U.S. Senator Rand Paul. The correspondence was sent out under the name of Senator Rand Paul, but we know Senator Paul is from KY and this mailing came from “Senator Rand Paul” with a post office box address in Fredericksburg VA.

Further research indicates this post office belongs to none other than the National Association for Gun Rights, a first cousin to the NRA. The inside of the package contains a two-page blurb written by Senator Paul, on mock Senate letterhead, indicating how critical it is to act immediately to protect the Second Amendment. Included was a full color photo of President Obama with their new and improved quotation from his speech. Paul goes on to explain the reason he agreed to help the National Association for Gun Rights fight back to stop the gun ban is because “They’re tough. They’re principled. And they know how to win.”

Senator Rand Paul and the NAGR are superior LIARS, a disgrace to the U.S. Senate, the Second Amendment and the entire country.

Background:

The Vietnam War technically began February 28, 1961 and did not end until May 7, 1975. Heroes that served our country during that period of time hit a brick wall upon their return to the states. The majority of citizens in this country did not want to be in an ‘endless’ war and in many instances took out their discontent on our returning Veterans.

Many of these Veterans were suffering from various degrees of PTSD when they left Vietnam and upon their return to the U.S. were greeted by citizens that did their best to make them feel unwelcome. The same was true in the job market, if you wanted a job after returning from Vietnam, it would be wise to leave your Vietnam service off your resume.

The one place where they should have been able to feel safe and secure while receiving the assistance they were desperate for, Veterans Affairs Medical Centers, basically cast them aside by giving them a bottle of sleeping pills, a pat on the back and a diagnosis of Schizophrenia. The American Psychiatric Association had not yet included PTSD in the DSM [The Diagnostic and Statistical Manual of Mental Disorders] therefore treating physicians did not fully recognize the severity of their symptoms.

About this same time there were other things going on in this country, plane crashes, train crashes, accidents, natural disasters, etc. More and more victims were complaining of symptoms similar to those of Vietnam Veterans and by 1980 the American Psychiatric Association finally added a diagnosis of PTSD to the DSM.

Since the majority of individuals experiencing PTSD symptoms were treated at Veterans Affairs Medical Centers, Veterans Affairs became acutely aware of the need for readjustment counseling for Veterans and in 1979 Congress established “The Vet Center Program” for Vietnam Veterans. In 1991 Congress extended eligibility to Veterans that served in Lebanon, Grenada, Panama, the Persian Gulf, Somalia and Kosovo/Bosnia. WWII and Korean combat Veterans were included in 1996, and in 2003 Veterans from Operation Enduring Freedom and Operation Iraqi Freedom were added to the coverage. It is important to note that from the beginning Veterans Affairs recognized PTSD as a ‘family’ disorder and extended readjustment counseling to the families.

What Services are provided?

Readjustment counseling is a wide range of psycho social services offered to eligible Veterans and their families in the effort to make a successful transition from military to civilian life.  They include:

  • Individual and group counseling for Veterans and their families
  • Family counseling for military related issues
  • Bereavement counseling for families who experience an active duty death
  • Military sexual trauma counseling and referral
  • Outreach and education including PDHRA, community events, etc.
  • Substance abuse assessment and referral
  • Employment assessment & referral
  • VBA benefits explanation and referral
  • Screening & referral for medical issues including TBI, depression, etc.

Operation Ranch Hand and Agent Orange – 50 Years Later

Agent Orange is a blend of tactical herbicides developed by the United States Department of Defense for use in ‘combat operations’ in Vietnam.

During the period of 1962 to 1971 more than 19 million gallons of various herbicide combinations were sprayed in country, but Agent Orange was the combination used most often.  It was named “Agent Orange” due to the orange stripe on the 55-gallon drums used for storage.  The purpose of the spraying was to remove trees and other dense tropical foliage providing enemy cover under Operation Ranch Hand.

The various agents were known as the Rainbow Herbicides due to the multiple colors as follows:  Agent Pink, Agent Green, Agent Purple, Agent Blue, Agent White and Agent Orange.

Agent Orange contained two active ingredients in equal amounts 2,4-dichlorophenoxyacetic acid (2,4-D) and 2,4,5-trichlorophenoxyacetic acid (2,4,5-T), which contained traces of 2,3,7,8-tetrachlorodibenzo-p-dioxin (TCDD).

TCDD is the most toxic of the dioxins, and classified as a human carcinogen by the Environmental Protection Agency [EPA].  The TCDD was an unwanted byproduct of herbicide production which was released into the environment by burning waste, diesel exhaust, chemical manufacturing and other processes.

Were you exposed to Agent Orange?

Veterans who served anywhere in Vietnam between January 9, 1962 and May 7, 1975 are presumed to have been exposed to herbicides.

In addition to locations in Vietnam, some soldiers may have been exposed in the following locations:

  • Along the demilitarized zone in Korea between April 1, 1968 and August 31, 1971
  • On or near the perimeters of Thailand Military Bases between February 28, 1961 and May 7, 1975
  • Possible exposure due to herbicide tests and storage at military bases in the United States and locations in other countries
  • Possible exposure of crew members to herbicide residue in C-123 planes flown after the Vietnam War

Veterans who were exposed to Agent Orange may be eligible for VA disability compensation and health care benefits for the following presumptive diseases associated with exposure to herbicides:

  • AL Amyloidosis
    A rare disease caused when an abnormal protein, amyloid, enters tissues or organs
  • Chronic B-cell Leukemias
    A type of cancer which affects white blood cells
  • Chloracne (or similar acneform disease)
    A skin condition that occurs soon after exposure to chemicals and looks like common forms of acne seen in teenagers. Under VA’s rating regulations, it must be at least 10 percent disabling within one year of exposure to herbicides.
  • Diabetes Mellitus Type 2
    A disease characterized by high blood sugar levels resulting from the body’s inability to respond properly to the hormone insulin
  • Hodgkin’s Disease
    A malignant lymphoma (cancer) characterized by progressive enlargement of the lymph nodes, liver, and spleen, and by progressive anemia
  • Ischemic Heart Disease
    A disease characterized by a reduced supply of blood to the heart, that leads to chest pain
  • Multiple Myeloma
    A cancer of plasma cells, a type of white blood cell in bone marrow
  • Non-Hodgkin’s Lymphoma
    A group of cancers that affect the lymph glands and other lymphatic tissue
  • Parkinson’s Disease
    A progressive disorder of the nervous system that affects muscle movement
  • Peripheral Neuropathy, Acute and Subacute
    A nervous system condition that causes numbness, tingling, and motor weakness. Currently, it must be at least 10 percent disabling within one year of herbicide exposure and resolve within two years. VA proposed on Aug. 10, 2012, to replace “acute and subacute” with “early-onset” and eliminate the requirement that symptoms resolve within two years.
  • Porphyria Cutanea Tarda
    A disorder characterized by liver dysfunction and by thinning and blistering of the skin in sun-exposed areas. Under VA’s rating regulations, it must be at least 10 percent disabling within one year of exposure to herbicides.
  • Prostate Cancer
    Cancer of the prostate; one of the most common cancers among men
  • Respiratory Cancers (includes lung cancer)
    Cancers of the lung, larynx, trachea, and bronchus
  • Soft Tissue Sarcomas (other than osteosarcoma, chondrosarcoma, Kaposi’s sarcoma, or mesothelioma)
    A group of different types of cancers in body tissues such as muscle, fat, blood and lymph vessels, and connective tissues

Please Don’t Ignore the Warning Signs – “Smell Gas, Act Fast”

Saturday afternoon I went downstairs to put some clothes in the dryer. Usually I don’t go any further than the laundry room because the rooms beyond haven’t been cleaned out since our last son moved. My intent was to have my helper start packing later that day so I figured, while I was downstairs, I’d take a quick peek in the rooms to get a general idea how many storage boxes would be needed. I never got that far.

As I walked past the furnace I smelled the very distinct smell of natural gas. It wasn’t a strong smell, just a very faint smell so I asked my helper to come downstairs. When she walked in the door to the laundry room I asked if she smelled anything and she said no, so I asked her to go into the other room and she never got that far. As she walked in front of the furnace she said she smelled gas, so I contacted our local gas company.

I told them that if there was a leak it was probably was a small leak because the smell wasn’t very strong, but they asked we follow their normal safety precautions as follows:

  1. Do not hang up the land line, they will disconnect from their office [they prefer you leave first and then call].
  2. Do not turn anything electrical on or off, leave everything running as is.
  3. Do not light any matches or use a flame for anything.
  4. Do not use any cell phones on your way out.
  5. Get everyone out of the house, but stay on a neighboring property so you can show the representative the problem when they arrive. Wait time 30-60 minutes.

It was just a little more than 30 minutes when the gas technician arrived. As he waved his magic wand up and down the pipes it was easy to determine that there was, indeed, a gas leak due to the sound made by his equipment.

He spent about an hour checking out the furnace and repairing the leak, which was apparently due to substandard installation of our relatively new furnace. In addition to the one pipe not being connected properly, it was also loose enough that you could move it just by touching it and sooner, rather than later, would have been a major problem.

The technician told me the leak had been there for quite a while but because of the fact natural gas travels up when released and in this instance the leak was only about 12″ from the ceiling, the escaped gas would have been dispersed into the air and gone unnoticed.

I seriously doubt that we were ever in any major danger, but the fact remains the best course of action – as determined by the gas company saying is “Smell Gas, Act Fast”.

What does $5.7 Billion buy these Days?

$5.7 billion dollars is a staggering amount, especially when you take into consideration its buying power.

According to the Congressional Budget Office a full year of CHIP [Children’s Health Insurance Program] funding for the years 2016 through 2022 would cost U.S. taxpayers $5.7 billion dollars per fiscal year

A deficit reduction counter-offer made by House Speaker John Boehner back in December 2012 included raising the Medicare retirement age from 65 to 67. That change would amount to $5.7 billion dollars in spending cuts.

The VA budget for 2013 contains two items that add to a little less than $5.7 billion dollars as follows:

$3.3 billion to meet the needs of more than 610,000 veterans returning from operations in Iraq and Afghanistan.

$2.2 billion for improved benefits claims processing (increased staff, improved processes and IT enhancements).

Let’s throw in one more for good measure – funding for the CH-47 Chinook Helicopter will cost $5.7 billion for the period beginning FY2013 and ending FY2017. The Chinook is the heavy-lift helicopter used to transport cargo, troops and weapons.

As you can see, $5.7 billion is nothing to sneeze as when it comes to the good it can do for U.S. taxpayers.

The Federal Election Commission recently released the totals for the 2012 Election Cycle and once again the number $5.7 billion appears. This time as the total amount of receipts collected during the 2012 election cycle which began January 1, 2011 and ended September 30, 2012.

What is interesting to note is the split. The majority of funds $1.7 billion were donated to PACs, with $1.6 billion donated to Congressional candidates, $1.4 billion donated to Party Committees [RNC and DNC], and the smallest amount, $1.0 billion was donated to presidential candidates.

There were 129 million [129,067,662] votes cast in the 2012 election which means $44.64 was donated to the various campaigns for each and every vote cast in the election.

We learned a valuable lesson in 2012, we learned that money doesn’t buy votes so what will happen during the 2014 Congressional elections? Will major individual and corporate contributors remember that votes can’t be bought and donate their money towards worthy causes or will they continue to give credence to the Bible verse “…every fool will be meddling.”

Only time will tell.

Reflections on Two Grains of Rice

Senator Lindsey Graham [R-SC] and Senator John McCain [R-AZ] have several things in common. They are both long-term members of the United States Senate, they are both members of the Senate Armed Services Committee, they are both Republicans and they both came down hard on United Nations Ambassador Susan Rice for calling the attack on Benghazi a “spontaneous demonstration” as opposed to a terrorist attack during her five September 16, 2012 TV appearances.

McCain and Graham made it crystal clear they will attempt to block any possible nomination of U.N. Ambassador Rice to the position of Secretary of State, including filibuster. McCain suggested he’ll block her nomination due to the fact Rice’s comments either fall under the heading of a Watergate-style cover-up, or the “worst kind of incompetence”, while Graham won’t back anyone who is “up to their eyeballs in the Benghazi debacle”.

Mike Morell, Acting CIA Director told Congress during the closed-door session of the House Intelligence Committee on Thursday, November 15, 2012 that U.N. Ambassador Susan Rice was provided with an “unclassified version” of the events that took place September 11, 2012 at Benghazi, according to Rep. Adam Schiff [D-CA].

The ‘unclassified’ version of CIA talking point read as follows:

· "The currently available information suggests that the demonstrations in Benghazi were spontaneously inspired by the protests at the US Embassy in Cairo and evolved into a direct assault against the US diplomatic post in Benghazi and subsequently its annex. There are indications that extremists participated in the violent demonstrations.

U.N. Ambassador Susan Rice simply reiterated the information she was provided by CIA.

“The Honorable” is the formal address reserved for Members of Congress and I fail to find anything ‘honorable’ about the ridiculous spectacle John McCain and Lindsey Graham made when discussing Ambassador Rice, without knowing all the facts!

Aside from the fact these two jumped the gun, what I really want to know is where were they during the other Rice debacle?

Does the name Condoleezza Rice ring a bell with anyone?

Condoleezza Rice made history on December 17, 2000, when she was chosen to serve as the first woman National Security Advisor for a period that began on January 20, 2001 and ended January 26, 2005 when she became the 66th Secretary of State.

During the 911 Commission hearings most of us learned that, on an almost daily basis during the summer of 2001 Rice met with then CIA Director, George Tenet, and on July 10, 2001 Director Tenet requested an emergency meeting to brief Rice and her staff on the possibility of a pending attack by Al Qaeda. Rice claimed she did not recall the meeting, but White House records confirmed the meeting was, in fact held.

Two months later, on September 11, 2001, an attack was made against citizens of the United States, on our own soil, and almost 3,000 individuals perished.

In response to the events of 9/11 the United States attacked Afghanistan on October 7, 2001.

Why were we attacked by Al-Qaeda?

On December 27, 2001 Osama Bin Laden released a video to Al-Jazeera regarding various events including the 9/11 attack and BBC posted the following excerpt from the video:

“Terrorism against America deserves to be praised because it was a response to injustice, aimed at forcing America to stop its support for Israel, which kills our people.”

Our support for Israel hadn’t waned; in fact, the 2012 budget amount submitted to Congress in February of 2011 by President Obama for a particular weapons system in Israel was doubled by the Republican controlled House on H.R. 1540. It was only one of the three areas where the amount allocated was more than requested in the President’s budget. Would you care to guess what was decreased in order to provide Israel with the additional funds?

After our attack on Afghanistan we began to hear rumblings from our government on weapons of mass destruction in Iraq.

Iraq delivered its 12,200-page declaration on Weapons of Mass Destruction to the United Nations on December 8, 2002.

Several weeks later, on January 23, 2003, National Security Advisor, Condoleezza Rice wrote an editorial published in the New York Times, calling the 12,200 Iraq report a “lie”. "Iraq has filed a false declaration to the United Nations that amounts to a 12,200-page lie". Condoleezza Rice is also a Republican.

Less than two months later, on March 19, 2003, the United States attacked Iraq. Hundreds of thousands of Iraqi’s were killed, maimed, or forced to leave their homeland, while U.S. taxpayers footed the bill for billions upon billions of dollars to be blown up in a puff of smoke. It is estimated by CRS that direct costs from the two wars exceeded $1.28 trillion dollars as of March 18, 2011.

It is a fact the following four American citizens were killed on September 11, 2012 during an attack on our embassy in Benghazi, Libya. U.S. Ambassador John Christopher Stevens, Information Management Officer, Sean Smith [former member of the U.S. Air Force] and two private security contractors Tyrone S. Woods and Glen A. Doherty. Both Woods and Doherty were former U.S. Navy SEALS.

It is also a fact that as of 10:00 a.m. on November 15, 2012 there have been a total of 56,847 U.S. Military personnel killed and or wounded in OIF [Operation Iraqi Freedom], OEF [Operation Enduring Freedom] and OND [Operation New Dawn].

Where were Senator McCain and Senator Graham almost a decade ago? Why weren’t they going over every word spoken with a fine tooth comb?

It appears Republicans have something else in common; they are very quick to call anyone and everyone a liar, if calling the person a liar helps them meet the goals they have set for their Party.

Unfortunately, this time around all it does is make them look like the fools they are.

Let all of them secede – The Rest of Us Need the Money!

We the People” is a website created by the White House where U.S. Citizens can create petitions on any subject of interest to them. 25,000 signatures are necessary for the petition to receive further attention from the White House.

Since President Obama’s re-election this website has been bombarded with petitions from various states wanting to secede from the Union and I say “Good Riddance”.

To date, there has only been one state that has reached the 25,000 threshold and that is the State of Texas with 93,972 votes as of November 14, 2012. According to the Census Bureau the estimated population for 2011 for the State of Texas is 26.7 million, so although 94,000 is a pretty fair number, its minute when it comes to total population. 267,000 signatures would only amount to 1% of the population.

The petition reads as follows:

Seems the folks in Texas can’t make up their minds because while the State of Texas is requesting to secede, citizens in the City of Austin have a separate online petition to remain part of the United States.

So what happens now? Probably nothing. In 1869 the Supreme Court ruled in Texas v. White that it was illegal for Texas to secede from the Union which is probably good for the people in the State of Texas. No matter how much they dislike the fact that President Obama was re-elected to a second term, the fact remains that Texans do not do a very good job of supporting themselves.

$163 billion dollars was the amount paid to the IRS from Texans in fiscal year 2009, while the State received $224 billion in federal funds, or to put it bluntly U.S. taxpayers from other states paid $61 billion dollars to residents of the State of Texas.

Is it any wonder Governor Perry’s office made the following statement on Tuesday, November 13, 2012:

"Gov. [Rick] Perry believes in the greatness of our Union and nothing should be done to change it," his press secretary Catherine Frazier wrote in a statement. "But he also shares the frustrations many Americans have with our federal government."

Texas may be the largest state in the Union, but it’s also the state that has the highest number of natural disasters requiring FEMA assistance as follows:

The Republican Wall of Ignorance

Speaker John A. Boehner (R-OH) made the following statement on November 9, 2012, which is the same position the Republican Party has taken for years on the subject of taxes.

“Raising tax rates will slow down our ability to create the jobs that everyone says they want,” said Mr. Boehner

The Congressional Research Service (CRS) prepared a report comparing job growth under President Clinton and higher tax rates, to job growth under President Bush and lower tax rates.

As usual, the numbers speak for themselves (see graphic above).

The annual average on Private employment growth doubled under higher taxes, while business investment growth nearly doubled increasing from 5.6% to 10.3%. In addition, seven of the nine major economic indicators increased under higher tax rates. One remained the same, and one decreased .2 percentage points.

Data from 2001 and 2002 was not included in the calculations due to the fact the tax increases were not fully impletemented until 2003. Data from 2008 was not included due to the Great Recession which began that year.

GDP growth was also higher at an annual average of 3.9% under higher taxes, compared to 2.7% under lowered tax rates.

Two of the major tax cuts passed during the last decade were the Economic Growth and Tax Relief Reconcillation Act of 2001 – P.L. 107-6 and the Jobs and Growth Tax Relief Reconciliation Act of 2003 – P.L. 108-27. Please note the word “growth”. The tax cuts were intended to spur job growth in this country. That was the entire purpose of providing the cuts, but they were a gross failure and the country ended up losing more than 8 million jobs due to the tax cuts and subsequent recession.

Many times I have commented in my articles on how the public is being brainwashed by hearing things over and over again. If you hear something 10 or 12 times, most of us start believing it’s fact.

Is it possible the Republican Party has been so busy trying to brainwash the American public on how tax increases prohibit business growth that they have brainwashed themselves into believing it’s an actual fact? If not, how does one explain their ignorance on the subject of job growth, taxes and our runaway deficit?

The April 2011 CRS report on the budget deficit makes a crystal clear statement that the tax cuts were the major factor in our deficit as follows:

‘For the decade as a whole, it can be estimated that legislative changes have increased deficits, relative to the 2001 baseline projections, by $6.9 trillion. Laws enacted in 2001 and 2003, notably the “Bush tax cuts,” generated the largest 10-year increases in budget deficits.’ Source: Reducing the Budget Deficit – Policy Issues – CRS 41778

The Congressional Research Service is the policy research arm of the United States Congress. These are the experts assigned the task of researching the pros and cons of the various policies put forth by Congress. Speaker of the House Boehner would do well to start reading facts rather than relying on fiction.

Defining Democracy for the Majority [of special interest to women]

Looking up the word democracy in a lot of different sources will provide you with several similar meanings; but the two words that generally prevail in all definitions are ‘free’ and ‘equal’.

Are we free and equal?

We’re neither, we’re ‘controlled’. We’re controlled by a small group of white elites who believe freedom applies only to those that are equal to them. In other words if you’re not Caucasian and you’re not wealthy you’re not free and if you’re not a white male, you’re not equal.

A primary example of non-democracy at work is the early closing of the Winter Park Florida library, located in Orange County Florida. The library was evacuated with an estimated 300 people still standing in line that had waited for hours to vote, due to a suspicious package being found outside. The article goes on to say the package was a cooler that was later detonated by the bomb squad.

The two major political parties went to court, one to request an extension of voting hours to accommodate the folks that weren’t able to participate in our ‘free and equal’ election system and the other political party to appeal the court’s decision to provide four hours of extended voting.

According to the U.S. Census Bureau the State of Florida has an average white (non-Hispanic) population for 2011 of 57.5 percent; while Orange County figures come in at 45.8 percent. In other words Orange County has a population that is 11.7 percent higher in blacks, Hispanics, Asians, etc.

Is it any wonder the Party of “NO” would want to put the kibosh on this group of voters? If you’re wondering what a difference 300 votes can make, take a look at the results of the 2000 election results.

I had a personal experience involving ‘control’ in this election. Several weeks ago I received notification that my voting card had ‘expired’ and if I wanted to vote in the 2012 election I would have to mail in an application. I mailed the application, only to be sent another form to fill out, which I did; all the time seething that my predominately Republican county was putting voters through this nonsense.

I eventually got all my ducks in a row and voted by mail, but whether or not my vote will be counted is yet to be determined. As a former election judge I am fully aware of the large number of votes that aren’t counted in each election due to the voter failing to dot the “I’s, cross the “t’s”, not fill in the ovals completely or not sign the outside of the envelope on mail ballots.

We know by media reports that Republicans have done everything humanly possible in this election to limit the number of votes that President Obama will get from various sections of the country. Add to that the number of outright lies and innuendo that has been dumped on the average voter from the candidates, the Republican Party, and especially the Super Pac’s, and it’s totally amazing that any of us bother voting. I mean can you imagine waiting in line for six or seven hours to vote?

We do it because we, as Americans, believe in the way it should be. We believe that all the citizens in this country are equal and every one of us should have the right to the American Dream. The problem is we aren’t all equal. The Equal Rights Amendment written in 1923 by Alice Paul consists of three sentences as follows:

Section 1. Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.

Section 2. The Congress shall have the power to enforce, by appropriate legislation, the provisions of this article.

Section 3. This amendment shall take effect two years after the date of ratification.

In 1971 the ERA bill was approved by the U.S. House by a vote of 354-24 and on March 22, 1972 the U.S. Senate passed the bill by a vote of 84-8.

There are two separate ways a proposed amendment to the U.S. Constitution may be made; one has never been used so the most common is for the bill to be sent to the individual state legislatures for ratification, or approval. Generally there is a time limit placed on the bill and the time limit was originally set at 7 years. Since the ERA amendment was not ratified within the original 7 year period, a bill has been reintroduced into Congress on a regular basis. The latest bill for the ERA was introduced on 10/2/2012.

The ERA bill already has approval of 35 of the 38 states necessary for ratification and once three more states ratify it will become an amendment to the U.S. Constitution.

We only need three approvals out of a possible 15 states, but the majority of these states are what are considered “red/ or Republican’ states and the possibility of a female getting ‘equal rights’ in a red state are between zip, zero and nada.

Please do not confuse equal rights for women, with equal pay for women. The Lilly Ledbetter Fair Pay Act of 2009 was the very first bill signed into law by President Obama when he took office in 2009. This bill provides equal pay for women for equal work.

Equal rights for women require a constitutional amendment. Women will never have equal rights under a Republican president because in simple English, Republicans do not feel women are their equals, as can be determined by bill after bill they have introduced taking away women’s right.

Your vote on November 6, 2012 (assuming you have not already voted) will not only affect your future, but the future of all the women in this country.

Yeah Right!

Just finished reading a New York Daily News article stating the latest Gallup Poll shows Governor Romney is now ahead of President Obama by a whopping seven points based on Gallup’s poll of ‘likely’ voters.

When I quit laughing at the absurdity, I decided to take a look at how Gallup came up with their spiffy nifty poll numbers.

My idea of a poll is as follows: You call up xxx number of registered voters, representing Republicans, Democrats and Independents and you ask the following question.

If the Presidential election were to be held today would you vote for President Barack Obama, the Democrat or would you vote for Governor Mitt Romney, the Republican candidate?

When you’re all done you add up the number of registered voters that would vote for Romney and the number of registered voters that would vote for Obama and you have a winner! Voila’

The problem with my poll is it doesn’t provide the means for playing games with the numbers so it would never work in our real world of deceptive politics.

For some reason Gallup does not think asking a registered voter who they’re going to vote for is the way to go so instead of asking potential voters one question; they ask seven more and then they weigh the questions and answers. Their method of polling is so complex they have a full page of explanations called “Understanding Gallup’s Likely Voter Procedures for Presidential Elections“.

If you read the fine print you’ll see that Gallup may or may not use all answers to all questions, so why bother asking?

My first problem with their polling is they do not start with registered voters. I mean really and truly who cares how someone may vote if they are not even registered to vote? Do you care who Charlie Chimp down the street might vote for if Charlie isn’t registered to vote? I don’t.

If you have some time take a look at their polling procedures and then ask yourself how much credence anyone in this country can give a Gallup poll?

1.7% COLA Increase for Social Security Beneficiaries for 2013

Social Security benefits are being paid to roughly 62 million Americans. The largest portion, 56 million will see the 1.7 percent increase on their January 2013 checks, while the remaining SSI beneficiaries will receive the increase on their December 31, 2012 check.

P.L. 92-336, established automatic increases to Social Security and SSI benefits each year based on the percentage CPI-W [Consumer Price Index for Urban Wage Earners and Clerical Workers] increased from the third quarter of the last year a COLA was determined to the third quarter of the current year. The actual CPI-W percentage is calculated by the Bureau of Labor Statistics. Prior to the signing of P.L. 92-336 Cost of Living Adjustment Allowances were only made when Congress approved an increase.

Good thing we have P.L. 92-336 because the chances of the 112th Congress approving a COLA increase for anyone other than the very wealthy is probably between slim and none. On the other hand, perhaps the vision of 62 million old folks beating on the walls of Congress with their umbrellas, canes and walkers is incentive enough.

It is estimated 163 million workers pay into Social Security. Out of that 163 million, approximately 10 million will pay higher taxes in 2013 as the maximum amount of earnings subject to the Social Security tax will increase from $110,100.00 to $113,700.00.

Social Security and Medicare tax rates are scheduled to stay the same for 2013 as they are for 2012. As indicated on the following Social Security chart, we are operating under a 2% reduction which is scheduled to expire at the end of December 2012.

It is highly unlikely this rate will increase by the 2% for calendar year 2013 due to the extraordinary burden it will place on the middle-class.

As of June 30, 2012 approximately 89 percent of American individuals age 65 and over were receiving Social Security benefits.

At least 40 percent of those receiving Social Security benefits in 2012 rely entirely on their Social Security benefits for survival as they have no other income. Please take that fact into consideration when you vote on November 6.

15 States, 19 Deaths, 247 Reported Cases*

The Tennessee Department of Health was first notified on September 18, 2012 of culture-confirmed, Aspergillums fumigatus meningitis. This diagnosis was made 46 days after the patient had received an epidural steroid injection at a Tennessee surgery center.

Within nine days an additional eight patients were clinically diagnosed through collaboration with the CDC, Tennessee Department of Health and the North Carolina Department of Health and Human services. Seven of these patients were in Tennessee and one was in North Carolina.

All nine infected patients had received one or more epidural steroid injections with preservative-free methylprednisolone acetate solution (MPA), compounded at NECC (New England Compounding Center) located in Framington Massachusetts.

It was determined the injections had come from one of three lots of MPA (lot numbers 05212012@68; 06292012@26; and 08102012@51).

During the subsequent investigation, NECC provided the CDC with invoice information indicating approximately 17,500 vials of MPA (80 mg/ml) from these lots had been packaged in 1ml, 2ml, and 5ml vials and subsequently distributed to 75 different facilities in 23 states for treatment of both peripheral joint and back pain.

NECC voluntarily recalled these three lots on September 26, expanded the voluntary to all lots of MPA and all lots of sterile products used for intrathecal injection by October 3 and followed up with a voluntary recall of all remaining products on October 6, 2012.

Follow-up investigations by CDC as well as state and local health departments indicated there were almost 14,000 patients potentially exposed to medications from at least one of the lot numbers and by October 10, 2012 the various departments advised CDC that approximately 90% of all patients had been contacted at least once, by telephone, voicemail, home visit or registered mail.

Four separate categories of cases have been identified as follows:

  1. Fungal meningitis or nonbacterial and nonviral meningitis of subacute onset following epidural injection on or after May 21.
  2. Basilar stroke following epidural injection on or after May 21.
  3. Spinal osteomyelitis or epidural abscess at the site of injections following epidural or sacroiliac injection on or after May 21.
  4. Septic arthritis or osteomyelitis of a peripheral joint (e.g., knee) diagnosed following injection of that joint on or after May 21

Clinical meningitis was defined as having one or more symptoms (e.g., headache, fever, stiff neck, or photophobia) and CSF pleocytosis.

Clinically diagnosed septic arthritis was defined as new or worsening pain with presence of effusion or new or worsening effusion.

Many times during this election cycle we have been subjected to the Republican term “Job-Killing Regulations“.

I don’t know about the rest of you, but I’d rather have a few jobs “killed” over government regulations than thousands of Americans dead because the regulations weren’t there to protect the public.

It will be months and perhaps years before we know all the answers to why these particular batches of MPA caused so many deaths and illnesses. In the meanwhile we can be extremely grateful to the CDC, other government agencies as well as Epi-X (the CDC electronic health notification system) for working so quickly to obtain the necessary information on the 14,000 potential cases and notify those patients of the possibility of exposure.

This particular story hits close to home as I’ve had numerous epidural injections over the past several years without side effects. The reason a person has a sacroiliac or epidural steroid injection is because they are in considerable pain and the injection generally takes away a certain amount of pain for a specific period of time, but they don’t always work. I can’t imagine what it would be like to have the injection and then get notified that due to the injection you may be subjected to a life-threatening illness.
